RESOLUTION NO. R-2011-�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING THE WAIVER OF
CERTAIN DEPARTMENTAL AND FACILITY RENTAL
PROGRAM FEES TO BE PROVIDED AS IN -KIND SUPPORT
TO THE TAMARAC PARKS AND RECREATION
FOUNDATION, INC. FOR THEIR USE IN PROVIDING
MEMBERSHIP INCENTIVES FOR THOSE SUPPORTING
THE FOUNDATION; PROVIDING FOR A MAXIMUM
INCENTIVE PACKAGE VALUE; PROVIDING FOR REVIEW
AND REVISION OF FUTURE INCENTIVES; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Resolution No. R-2011-35 authorized the appropriate City Officials to
take the necessary steps to submit a non-profit application to the appropriate State and
Federal agencies on behalf of the Parks and Recreation Department to create a not -for -
profit corporation known as the Tamarac Parks and Recreation Foundation, Inc.; and
WHEREAS, funds raised by the Tamarac Parks and Recreation Foundation, Inc.
are designated to be used to support the advancement of Parks and Recreation programs,
services and facilities in the City of Tamarac, and
WHEREAS, the Tamarac Parks and Recreation Foundation, Inc. is an entity that is
separate, independent and autonomous from the City of Tamarac and is not intended to
exist or be construed as an agency or arm of the City of Tamarac; and

WHEREAS, the City of Tamarac, Florida, wishes to support the Tamarac Parks and
Recreation Foundation, Inc. in their efforts; and
WHEREAS, the Director of Parks and Recreation recommends approving the waiver
of certain departmental program and facility rental fees to be provided as in -kind support to
the Tamarac Parks and Recreation Foundation, Inc. for their use in providing membership
incentives for those supporting the Foundation; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve the waiver
of certain departmental program and facility rental fees to be provided as in -kind support to
the Tamarac Parks and Recreation Foundation, Inc. for their use in providing membership
incentives for those supporting the Foundation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA-
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the waiver of certain departmental program and facility rental fees
to be provided as in -kind support to the Tamarac Parks and Recreation Foundation, Inc. for

their use in providing membership incentives for those supporting the Foundation, is
HEREBY APPROVED.
SECTION 3: At no time will any Membership Level incentive package incorporate
departmental program and facility rental fees to be waived in excess of $500.
SECTION 4: The Tamarac Parks and Recreation Foundation membership incentive
program shall be reviewed on a regular basis by the Director of Parks and Recreation to
assure the effectiveness of said program, and said program may be terminated if benefits
cannot be found. Revisions to the incentives may be approved by the City Manager.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION is This Resolution shall become effective immediately upon its passage
and adoption.
