CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2011-��
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, RECOMMENDING APPROVAL OF PROJECT ION
FOR A QUALIFIED TARGET INDUSTRY TAX REFUND;
RECOMMENDING PROJECT ION AS A QUALIFIED TARGET INDUSTRY
BUSINESS PURSUANT TO SECTION 288.106, FLORIDA STATUTES;
COMMITTING THE CITY TO PAYMENT OF A PERCENTAGE OF THE
QUALIFIED TARGET INDUSTRY TAX REFUND AS A LOCAL MATCH
AS REQUIRED BY STATE STATUTE; AUTHORIZING CITY OFFICIALS
TO PROVIDE A LOCAL MATCH OR LOCAL FINANCIAL SUPPORT FOR
THE QUALIFIED TARGET INDUSTRY TAX REFUND IN THE FORM OF
CASH; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the State of Florida, through Enterprise Florida, Inc. ("Enterprise
Florida"), offers tax refunds to local businesses as an incentive for the creation of new jobs
in Qualified Target Industries within the state;
WHEREAS, for businesses to be eligible for a Qualified Target Industry Tax Refund
they must: 1) apply to Enterprise Florida prior to making a decision to locate or expand in
the state; 2) be in a target industry; 3) demonstrate that the tax refund will make a material
difference in the company's decision to locate or expand in the state; 4) create at least ten
(10) new full-time equivalent Florida jobs or increase employment by ten percent (10%); 5)
pay an average annual wage that is 115% of the state, metropolitan statistical area, or
local average wages; 6) show that the added jobs make a significant economic
contribution to the area economy; and 7) provide a resolution from the appropriate city or
county commission recommending the applicant for the incentive and committing the city
or county to providing a match of funds equaling twenty percent (20%) of the tax refund,

WHEREAS, Project Ion, a qualified applicant under Section 288.106, Florida
Statutes, plans to create positions within a qualified industry consistent with the
requirements of the Qualified Target Industry Tax Refund;
WHEREAS, Project Ion applied to Enterprise Florida for a Qualified Target Industry
Tax Refund in support of expansion into a qualified industry;
WHEREAS, Section 288.085(2), Florida Statutes, allows a qualified applicant to
make a written request that information concerning its plans and intentions to expand its
business activities in the state remain confidential and exempt from disclosure;
WHEREAS, the total Qualified Target Industry Tax Refund to be granted to Project
Ion pursuant to Section 288.106, Florida Statutes, is expected to be Fifty One Thousand
Dollars ($51,000);
WHEREAS, in furtherance of its application, Project Ion requires a resolution from
the City Commission recommending Project Ion for the incentive and committing the City
to providing a match of funds equaling twenty percent (20%) of the tax refund;
WHEREAS, the City Commission finds it is in the best interests of the residents of
the City of Tamarac, to recommend Project Ion for receipt of a Qualified Target Industry
Tax Refund and commit the City to providing a match of funds equaling twenty percent
(20%) of the tax refund;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AS FOLLOWS:
Section 1. The foregoing 'WHEREAS" clauses are true and correct and
hereby ratified and confirmed by the City Commission.

Section 2. The City Commission of the City of Tamarac, Florida, hereby
recommends Project Ion be approved as a Qualified Target Industry Business pursuant to
s.288.106, Florida Statutes.
Section 3. The City Commission of the City of Tamarac, Florida, commits the
City to payment of the necessary cash local financial support for Project Ion for the State's
Qualified Target Industry Tax Refund Program in the amount of up to Ten Thousand Two
Hundred Dollars ($10,200). This amount will be made available in accordance with the
guidelines set forth by the Department of Economic Opportunity, with the stipulation that
these funds are intended to represent the "local financial support" required by s.288.106,
Florida Statutes.
Section 4. The appropriate officials of the City of Tamarac, Florida, are hereby
authorized to distribute to the State of Florida's Department of Economic Opportunity, or its
designated agents, on behalf of Project Ion, funds up to Ten Thousand Two Hundred
Dollars ($10,200), as the required local match to the Qualified Target Industry Tax Refund
Program.
Section 5. The City Commission of the City of Tamarac, Florida, has determined
the basis of this project's average private sector wage commitment calculation shall be
115% of the County average annual wage.
Section 6. All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 7. If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 8.

This Resolution shall become effective immediately upon its
