A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, SETTING FORTH THE CITY'S INTENT TO USE
THE UNIFORM METHOD FOR THE LEVY AND COLLECTION OF NOW
AD VALOREM SPECIAL ASSESSMENTS TO BE INITIALLY LEVIED
FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 20127 ONE TO
BE LEVIED UPON RESIDENTIAL REAL PROPERTIES LYING WITHIN
THE MUNICIPAL BOUNDARIES OF THE CITY TO FUND THE
PROVISION OF SOLID WASTE COLLECTION SERVICES TO
RESIDENTIAL PROPERTIES WITHIN THE CITY, AND ONE TO BE
LEVIED ON ALL REAL PROPERTIES LYING WITHIN THE MUNICIPAL
BOUNDARIES OF THE CITY TO FUND ENHANCEMENTS,
IMPROVEMENTS, ADDITIONS TO, AND MAINTENANCE OF, THE
CITY'S STORMWATER UTILITY SYSTEM; STATING A NEED FOR
SUCH LEVIES; PROVIDING FOR A DESCRIPTION OF THE
BOUNDARIES OF THE PROPERTY SUBJECT TO THE SPECIAL
ASSESSMENTS, WHICH ARE THE MUNICIPAL BOUNDARIES OF THE
CITY AS DESCRIBED IN EXHIBIT "A" ATTACHED HERETO;
PROVIDING THAT A COPY OF THIS RESOLUTION SHALL BE
FORWARDED TO THE PROPERTY APPRAISER, TAX COLLECTOR
AND THE FLORIDA DEPARTMENT OF REVENUE; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.

WHEREAS, the City Commission of the City of Tamarac, Florida (the "City')
intends to impose two special assessments: (1) to fund the provision of solid waste
collection services to residential properties within the geographical boundaries of the City;
and, (2) to fund enhancements, improvements, and additions to, and the maintenance of,
the City's Stormwater Utility System; and,
WHEREAS, in accordance with Section 197.3632(3)(a), Florida Statutes, the City

advertised its intent to use the Uniform Method for the collection of the assessments
weekly in a newspaper of general circulation for four (4) consecutive weeks preceding the
public hearing held the day hereof. Proof of publication of such hearing being attached
hereto as Exhibit "B"; and
WHEREAS, the City Commission held a duly -advertised public hearing for the
assessments prior to the adoption of this Resolution; and
WHEREAS, pursuant to Section 197.3632, Florida Statutes, as amended, the City
Commission of the City of Tamarac desires to set forth its intent to use the uniform
method of levying and collecting non -ad valorem special assessments for a non -ad
valorem special assessment to be levied upon residential properties within the City to
fund the costs of providing solid waste collection services to residential properties located
within the municipal boundaries of City, more particularly described in Exhibit "A,"
attached hereto and made a part hereof; and, for a non -ad valorem special assessment
to be levied on all real properties within the City to fund enhancements, improvements,
and additions to, and the maintenance of, the City's Stormwater Utility System within the
municipal boundaries of the City more particularly described in Exhibit "A," attached
hereto and made a part hereof, because this method provides an economical and
efficient process for such special assessments. These assessments will be collected
annually, commencing in November 2012; and
WHEREAS, the City Commission of the City of Tamarac, Florida, directs the City
Clerk to provide copies of this Resolution to the Property Appraiser, Broward County

Department of Revenue Collections (which serves as the Tax Collector for Broward
County) and the Florida Department of Revenue on or prior to January 10, 2012;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AS FOLLOWS:
Section 1. The foregoing "WHEREAS" clauses are true and correct and hereby
ratified and confirmed by the City Commission.
Section 2. Commencing with the Fiscal Year beginning on October 1, 20121
and with the tax statement mailed for such Fiscal Year, the City intends to use the
Uniform Method authorized in Section 197.3632, Florida Statutes, as amended, to
annually collect a non -ad valorem special assessment to be levied upon residential
properties within the City to fund the costs of providing solid waste collection services to
residential properties located within the municipal boundaries of City, more particularly
described in Exhibit "A," attached hereto and made a part hereof. For purposes of this
resolution, the term "residential" for the solid waste collection services assessment means
single family units and all other units receiving residential solid waste collection services.
Section 3. Commencing with the Fiscal Year beginning on October 1, 20121
and with the tax statement mailed for such Fiscal Year, the City intends to use the
Uniform Method authorized in Section 197.3632, Florida Statutes, as amended, to
annually collect a non -ad valorem special assessment to be levied on all real properties
within the City to fund enhancements, improvements and additions to, and the
maintenance of, the City's Stormwater Utility System within the municipal boundaries of

the City more particularly described in Exhibit "A," attached hereto and made a part
hereof.
Section 4. The City hereby determines that the levy of the non -ad valorem
special assessments upon residential properties within the City is needed to fund the cost
of residential solid waste collection services to residential properties within the
incorporated area of the City.
Section S. The City hereby determines that the levy of the non -ad valorem
special assessments upon all real property within the City is needed to fund
enhancements, improvements, and additions to, and the maintenance of, the City's
Stormwater Utility System within the municipal boundaries of the City.
Section 6. Upon adoption, the City Clerk is hereby directed to send a
copy of this Resolution by United States mail, certified return receipt requested, to the
Florida Department of Revenue, the Broward County Department of Revenue Collection,
and the Broward County Property Appraiser on or before January 10, 2012.
Section 7. All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
Section 8. If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
