R-2011- 31 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A TIME EXTENSION OF ONE (1) YEAR FOR FINAL SITE PLAN APPROVAL FOR THE MERRILL GARDENS II PROJECT, REQUESTED BY EPP TECH ASSOCIATES, INC., (EDWARD P. PLOSKI), DESIGNATED AGENT FOR THE PROPERTY OWNER, TAMARAC ACQUISITIONS, LLC. (CASE NO. 5-SP-11); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 10 of the City of Tamarac Code of Ordinances provides that the City Commission may grant time extensions on Site Plan approvals; and WHEREAS, EPP Tech Associates, Inc., (Edward P. Ploski), Designated Agent for the property owner Tamarac Acquisitions, LLC., has requested to have the Site Plan for the Merrill Garden II project extended for one (1) year (attached hereto as Exhibit 1", incorporated herein and made a specific part thereof); and WHEREAS, the City Commission of the City of Tamarac, Florida, granted Major Revised Site Plan approval for the Merrill Gardens II project on March 25, 2009 via Resolution No. R-2009-43 (attached hereto as Exhibit "2", incorporated herein and made a specific part thereof); and WHEREAS, the City Commission of the City of Tamarac, Florida has previously approved a Site Plan Extension for the Merrill Gardens II project on March 10, 2010 via Resolution No. R-2010-27 (attached hereto as Exhibit "3", incorporated herein and made a specific part: thereof); and Temp Reso # 11999 March 14, 2011 Page 2 WHEREAS, the Director of Community Development recommends approval of the one (1) year Site Plan Extension; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac, Florida to grant a time extension of one (1) year for final Site Plan approval for the Merrill Gardens II project, as requested by EPP Tech Associates, Inc., (Edward P. Ploski), Designated Agent for the property owner Tamarac Acquisitions, LLC. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution, all exhibits attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: That the application for a one (1) year extension for the Merrill Gardens II project, requested by EPP Tech Associates, Inc. (Edward P. Ploski), Designated Agent for the property owner Tamarac Acquisitions, LLC, is hereby approved subject to the following conditions: 1 1 1 Temp Reso # 11999 March 14, 2011 Page 3 A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in the Development Review Status Sheet (attached hereto as Exhibit "4", of Temp Reso No. 11582 - Resolution No. R-2009-43) and approved final engineering drawings. B. Commencement of construction shall be no later than one (1) year from March 25, 2011 for the Merrill Gardens II project. If the development does not commence construction within one (1) year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Commission consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: 1. That if, in the future, there were more stringent requirements for approval of a Site Plan, that Merrill Gardens II would modify their Site Plan to accommodate those new regulations. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp Reso # 11999 March 14, 2011 Page 4 SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. The new facility will share services with the existing Merrill Gardens retirement community complex. Merrill Gardens has 42 existing studio units, 45 existing one -bedroom units & 8 existing two -bedroom units and the approved 22 bed Alzheimer care facility building. In March 2010, the City Commission approved a one year site plan extension for the Merrill Garden Master Site Plan. The reason for the extension was they could not obtain construction financing for the proposed 22 bed Alzheimer Care Facility building. The owners have invested money and time to have the site plan reviewed and approved by the City of Tamarac. They also had the property platted in conjunction with the 22 bed Alzheimer care facility building. The City of Tamarac and Broward County reviewed and approved the Merrill Garden II plat. The plat was recorded into the Broward County records in Plat Book 178, Pgs. 110 & 111; B.R.C. in March 2009. The United States is slowly moving out of the worst financial crisis since the Great Depression and the owners have still been unable to obtain construction financing for ASSOCIATES, INC.
