RESOLUTION NO. R-2011 p
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPROVING CHANGE ORDER #3, AMENDING
AN OPEN END TERM AGREEMENT WITH ROOFING CONCEPTS
UNLIMITED, INC. FOR THE CONSTRUCTION OF THE
PHOTOVOLTAIC PROJECT ADOPTED UNDER R-2009-170,
PROVIDING FOR FIXED PRICING FOR CONSTRUCTION OF
PHOTOVOLTAIC CELLS FOR MUNICIPAL FACILITIES FOR A PERIOD
OF 720 DAYS FROM DATE OF AWARD IN ACCORDANCE WITH BID
#09-18B, FOR AN AMOUNT OF $184,600 AND A 10% CONTINGENCY
OF $18,460.00 FOR A TOTAL NOT TO EXCEED $203,060.00 FOR
EACH FACILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac is committed to the concept of using
energy efficient technology; and
WHEREAS, the 2010 City of Tamarac Strategic Plan provides a vision for the City
including Strategic Goal #2 providing for a Strong Economy in a Healthy Environment; and
WHEREAS, the City Commission of the City of Tamarac wishes to provide for energy
saving and renewable energy activities toward the accomplishment of this strategic goal; and
WHEREAS, the U.S. Department of Energy (DOE) notified the City of Tamarac of a
Congressionally Directed Project (CDP) award in the amount of $800,000 under the Energy
and Water Development and Related Agencies Appropriations Act of 2010 for various energy
efficient procurements; and
WHEREAS, the City of Tamarac approved Resolution R-2009-170, authorizing the
appropriate city officials to execute an open end term contract agreement with Roofing
Concepts Unlimited, Inc. for a period of twelve (12) months from the date of contract award for

the construction of the Tamarac Photovoltaic Project, a copy of which is on file with the City
Clerk and incorporated herein and made a specific part of this resolution; and
WHEREAS, the Tamarac Photovoltaic Project included the following municipal facilities:
Public Works, Fire Station 15 & 41 and Parks and Recreation Administration Buildings; and
WHEREAS, the City of Tamarac wishes to amend the list of municipal facilities included
in the Tamarac Photovoltaic Project from those listed above to: Fire Stations 15 & 41, The
Parks & Recreation Building, Tamarac City Hall, and the IT/Utilities Building; and
WHEREAS, CDP funding is now available for orders for these sites to be issued at the
per site pricing of $184,600 plus 10% contingency of $18,460.00 for a cost not to exceed
$203,060.00 per site for a total expenditure increase from $1,015,300.00 to $1,218,360.00;
and;
WHEREAS, in order to complete this additional work, the contract time must be
increased by 600 days to a total of 720 days; and
WHEREAS, Roofing Concepts Unlimited, Inc. possesses the required knowledge and
experience for the construction of the proposed project and has agreed to the Terms and
Conditions, Special Conditions, and Technical Specifications of Bid No. 09-1813; and
WHEREAS, it is the recommendation of the Public Works Director and the Purchasing
and Contracts Manager that the appropriate City Officials execute Change Order #3, which
amends the project locations, the total contract price including contingency, and the contract
schedule to the agreement with Roofing Concepts Unlimited, Inc. attached hereto as Exhibit
A:, incorporated herein and made a specific part of this resolution; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the
best interest of the citizens and residents of the City of Tamarac to execute Change Order #3

to the agreement with Roofing Concepts Unlimited, Inc. to include the above list of municipal
facilities and amend the contract price and the contract schedule for the construction of the
Tamarac Photovoltaic Project,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed
as being true and correct and are HEREBY made a specific part of this Resolution. All exhibits
attached hereto are incorporated herein and made a specific part of this Resolution.
SECTION 2: The appropriate City Officials are HEREBY authorized to execute Change
Order #3 which amends the agreement with Roofing Concepts, Inc. to amend the installation
locations the contract price and the contract schedule for the construction of the Tamarac
Photovoltaic Pr mect.
SECTION 3: An appropriation for the receipt and expenditure for this grant and any
matching funds will be included in the next budget amendment pursuant to F.S. 166.241(2).
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are HEREBY
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it
shall not affect the validity of the remaining portions or applications of this Resolution.

SECTION 6: This Resolution shall become effective immediately upon adoption.

IN COMPLIANCE WITH SPECIFICATIONS IN THE ABOVE REFERENCED CONTRACT, THE CONTRACTOR
AND THE CITY DO BOTH HEREBY AGREE THAT THE CONTRACTOR SHALL MAKE THE FOLLOWING
CHANGES, ADDITIONS OR DELETIONS TO THE WORK SPECIFIED IN THE PLANS AND
SPECIFICATIONS.
DESCRIPTION:
1. Amend the Contingency Bid Location sites indicated on the Bid Schedule to reflect the removal of the
Public Works Building site and the addition of the City Hall Building and Utilities Building sites.
2. Increasing the total project expenditure in the amount of $203,060.00 as a result of adding one additional
installation site.
PURPOSE OF CHANGE ORDER:
To document the change of Solar Panel (PV) installation sites indicated on the Bid Schedule with no increase to the
original contractual unit pricing. This change order eliminates the Public Works Building site and provides for the
addition of the City Hall Building and Utilities Building sites as Contingency Bid Locations, increasing the total project
cost by $203,060.00.
