A'3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING APPROPRIATE CITY OFFICIALS TO TAKE ALL NECESSARY ACTION TO ACCEPT THAT CERTAIN QUIT CLAIM DEED FROM ARNOLD ROTHSTEIN AND RITA ROTHSTEIN, HUSBAND AND WIFE, REVERTING TITLE TO THE CITY OF TAMARAC, FLORIDA, A SLIVER OF ESCHEATED PROPERTY MISTAKENLY TRANSFERRED TO THE ROTHSTEINS BY VIRTUE OF A QUIT CLAIM DEED RECORDED IN OFFICIAL RECORDS BOOK 44918, PAGE 1825 OF THE PUBLIC RECORDS OF BROWARD, COUNTY, FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. ********** WHEREAS, on December 10, 2007, in accordance with actions taken by the City Commission under Resolution No. 2007-166, the City conveyed a small piece of escheated property identified by Folio No. 494105150301 to Mr. and Mrs. Arnold Rothstein (the "Rothsteins") by Quit Claim Deed recorded on December 18, 2007 in Official Records Book 44918, Page 1825 of the Public Records of Broward County, Florida; WHEREAS, the Rothsteins brought to the City's attention that the escheated property conveyed to them was not previously owned by them nor it is contiguous to their home, and have requested to revert title of this sliver to the City by Quit Claim Deed as attached in Exhibit A; WHEREAS, the City Commission finds that the Rothsteins received title to this escheated property in error and the escheated property should revert back to the City. Reso. # 11906 August 25, 2010 Page 2 of 3 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA that: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits referred to in the "WHEREAS" clauses are hereby attached hereto and incorporated herein by reference. SECTION 2: The City Commission of the City of Tamarac hereby authorizes the transfer of the sliver of escheated property identified by Folio No. 494105150301, currently owned by the Rothsteins, to revert back to the City of Tamarac. The City Commission of the City of Tamarac further authorizes the appropriate City officials to take the necessary actions to accomplish the conveyance of the subject escheated property to the City. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This resolution shall take effect immediately upon its adoption. Temp.
