CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2010- 1562
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC,
FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
APPROVE AN APPLICATION BY THE BROWARD SHERIFF'S OFFICE
FOR THE RELEASE OF LAW ENFORCEMENT TRUST FUNDS IN THE
AMOUNT OF $22,170 TO PROVIDE FUNDING FOR THE PURCHASE OF
A LIVESCAN ELECTRONIC FINGERPRINTING EQUIPMENT, IN
COMPLIANCE WITH THE AGREEMENT BETWEEN THE CITY OF
TAMARAC AND THE BROWARD SHERIFF'S OFFICE (BSO); PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac currently contracts for police services with the Broward
Sheriff's Office; and
WHEREAS, the Broward Sheriff's Office wishes to continue to work cooperatively with
the City of Tamarac to support the conduct of criminal background checks of employees and
volunteers to the extent required and permitted by Florida Statutes; and
WHEREAS, new legislation requires the digital transmission of fingerprints to FDLE and
the national FBI databases for certain City employees and volunteers; and
WHEREAS, the Broward Sheriffs Office will be able to use this equipment to obtain
elimination fingerprints from victims and witnesses at crime scenes throughout the City
significantly reducing potential investigative time; and
WHEREAS, funds exist in the Law Enforcement Trust Funds which can be utilized to
purchase this equipment which shall remain in the ownership of the City and earmarked for the
Tamarac District's use within the confines of the City; and
WHEREAS, in accordance with the requirements of the Agreement for police services,
the request shown as Exhibit A and Exhibit B has been determined to be in legal compliance
with Florida Statute 932.7055(4) by the City Attorney and is accompanied by a written
certification to that effect; and

WHEREAS, the City Manager, the BSO Chief of the Tamarac District, and the Director of
Human Resources recommend the acceptance of an application by BSO to allow for the release
of $22,170 to purchase the LiveScan Electronic Fingerprint Equipment; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the
best interest of the citizens and residents of the City of Tamarac to approve the application by
BSO to allow for the release of $22,170 to purchase the LiveScan Electronic Fingerprint
Equipment; and
WHEREAS, the City Commission of the City of Tamarac, pursuant to Section 166.241,
Florida Statutes, desires to budget and appropriate an amount not to exceed Twenty -Two
Thousand One Hundred and Seventy Dollars ($22,170) from the Law Enforcement Trust Fund
(LETF)
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Resolution. All exhibits
attached hereto are incorporated herein and made a specific part of this Resolution.
SECTION 2: The appropriate City officials are hereby authorized and directed to
approve the application by BSO, to allow for the release of $22,170 of Law Enforcement Trust
Funds to purchase the LiveScan Electronic Fingerprint Equipment to be used in the City of
Tamarac.
SECTION 1 The amount of Twenty -Two Thousand One Hundred and Seventy Dollars
($22,170) Dollars is hereby budgeted and appropriated, pursuant to Section 166.241, from
LETF funds.
SECTION 4: Furthermore, the appropriate City Officials are hereby authorized to
execute a payment from the Law Enforcement Trust Fund, payable to BSO, in order for BSO to

purchase the LiveScan Electronic Fingerprint Equipment.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall
not affect the validity of the remaining portions or applications of the Resolution.
SECTION T This Resolution shall become effective immediately upon its passage and
adoption. p �

Subject: Request for Approval of L.E.T.F. Purchase
This memorandum is forwarded to request approval to present to the Tamarac City
Commission a proposal for an expenditure of $22,170.00 from the Tamarac Law
Enforcement Trust Fund to fund the purchase and utilization of LiveScan Electronic
Finger rint Eqg ipmerjt. Additionally, as per section 12.4 of the current AGREEMENT FOR
POLICE SERVIcr=s, I am requesting a memorandum from the BSO Legal Unit certifying that
the request complies with the provisions of FSS 932.7055(4).
12.4 ... said request shall first be submitted to the BSO legal advisor
for a determination of the legality of the request. The Tamarac District
agrees to submit such application to the City Commission for
appropriation accompanied by a written certification that the request
complies with the provision of 932.7055(4) Florida Statutes.
The Broward Sheriffs Office Tamarac District is responsible for obtaining and submitting
fingerprints to FDLE for background checks for various applicants for City of Tamarac
employment and volunteer positions. Effective August 1, 2010 the law expanded to include
those working or volunteering with vulnerable populations. This will significantly increase
the number of people that will be mandated to submit to background checks. The
traditional fingerprinting method, using standard cards and inked prints submitted via mail,
is time consuming and messy. Fingerprints submitted to FDLE using LiveScan technology
results in a response time of 48 hours on average, significantly reducing the wait time for
background checks.
Program Overview
The LiveScan system allows for more efficient processing of applicants when compared to
traditional ink and card fingerprinting. The time required for a deputy to fingerprint multiple
applicants, as well as the time saved in clean up, will be drastically reduced. The LiveScan
system utilizes Computer technology and software to scan applicant fingerprints, determine
quality of prints to be submitted and stores each applicant's information electronically. The
applicant's information and fingerprints can then be submitted electronically to FDLE for
checks against state and national databases. This technology provides several benefits to
the Tamarac District;
The quality of the fingerprints is determined immediately by the software. This
eliminates potential rejection by FDLE that would necessitate repeating the process
days or weeks later.
The program can be used in a laptop computer, making the system portable.
Applicants fingerprinted by deputies for the City of Tamarac can be checked in an
average of 48 hours.
This technology will also be utilized to obtain elimination fingerprints from victims and
witnesses at crime scenes throughout the city. Detectives and Investigative Aides will be
able to respond to crime scenes and electronically capture prints which can be printed and
submitted along with potential suspect prints at the time of reporting, significantly reducing
the potential investigative time.
The funding request is necessary as this technology, while used by the Broward Sheriffs
Office for criminal fingerprinting, has not been implemented in the Tamarac District for
these purposes. This will be a new program for the Tamarac District and the equipment,
software and all related costs must be funded.
