R-2010- o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING AND ADOPTING THE BROWARD COUNTY DECEMBER 2009 REVISED MULTI -JURISDICTIONAL LOCAL MITIGATION STRATEGY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 163, Florida Statutes, requires municipalities and counties to plan for hazard mitigation, hurricane evacuation, post -disaster redevelopment planning, and local mitigation strategy; and WHEREAS, the State of Florida, Department of Community Affairs ("DCA") has designated Broward County Emergency Management division as the local coordinator of the Local Hazard Mitigation Plan for the municipalities located within Broward County; and WHEREAS, pursuant to City of Tamarac Resolution No. R2005-23 adopted February 23, 2005 (on file in the City Clerk's Office), the City adopted the Broward County Local Mitigation Strategy; and WHEREAS, the Broward County Board of County Commissioners has revised its original Local Mitigation Strategy to comply with the new mitigation planning criteria issued by the Federal Emergency Management Agency ("FEMA"), and has Temp. Reso. #11774 February 25, 2010 Page 2 subsequently adopted the Broward County December 2009 revision of the Multi - Jurisdictional Local Mitigation Strategy ("Plan"), attached hereto as Exhibit A; and WHEREAS, those Broward County municipalities adopting the Plan shall become eligible applicants, through the State of Florida, for mitigation grant programs administered by FEMA; and WHEREAS, adoption of the Plan further ensures that the City will remain eligible for hazard mitigation grant funding once a disaster has been declared by the President; and WHEREAS, the City Commission of the City of Tamarac understands the need for Local Mitigation Strategy; and WHEREAS, it is the recommendation of the Fire Chief that Tamarac continue to participate in the Local Mitigation Strategy program; and WHEREAS, the City Commission of the City of Tamarac, Florida deems that the adoption of the Broward Local Mitigation Strategy Plan is in the best interests of the health, safety, and welfare of the City, its residents, citizens and visitors. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Reso. #11774 February 25, 2010 Page 3 SECTION 2: The Broward County Multi -Jurisdictional Local Mitigation Strategy Plan is hereby supported and adopted by the City Commission of the City of Tamarac. SECTION 3: The City Clerk is hereby requested to send a copy of this Resolution to: Gary S. Friedman, LMS/Broward County Emergency Management Coordinator, Emergency Management Division, 201 NW 84 Avenue, Plantation, FL 33324. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. G EN CITY ATTORNEY 1 TR11774 - EXHIBIT A Resolution 2010--015 A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA SUPPORTING AND ADOPTING THE DECEMBER 2009 REVISION OF THE MULTI -JURISDICTIONAL LOCAL MITIGATION STRATEGY ("LMS") PLAN. WHEREAS, Section 322 of the Robert T. Stafford Disaster relief and Emergency Assistance Act, 42 U.S.C. 5165, as amended by the Disaster Mitigation Act of 2000 (DMA2K) (P.L. 106-390) provides for States, Tribes, and local governments to undertake a risk -based approach to reducing risks to natural hazards through mitigation planning. The National Flood Insurance Act of 1968, as amended, 42 U.S.C. 4001 et seq, reinforced the need and requirement for mitigation plans, linking flood mitigation assistance programs to State, Tribal and Local Mitigation Strategy ("LMS"), and WHEREAS, the Federal Emergency Management Agency (FEMA) has implemented various hazard mitigation planning provisions through regulation at 44 CFR § 201.6 requiring local governments to have a FEMA approved "LMS" in order to apply for and/or receive project grants, and WHEREAS, 44 CFR 201.6(d)(3) requires local jurisdictions to review and revise their LMS to reflect changes in development, progress in local mitigation efforts, and changes in priorities, and resubmit it for approval within five (5) years in order to continue to be eligible for mitigation project grant funding, and WHEREAS, the Broward County Board of County Commissioners adopted the Broward County Local Mitigation Strategy ("LMS") on April 12, 2005, and WHEREAS, The Federal Emergency Management Agency's (FEMA) approval of the current Broward County's Local Mitigation Strategy ("LMS") will expire on December 30, 2009, and WHEREAS, the December 2009 "LMS" was transmitted to FEMA through the Florida Division of Emergency Management (FDEM) and found in compliance with the local mitigation requirements of Section 322 of the DMA2K as implemented in 44 C.F.R., Part 201. NOW, THEREFORE, BE IT RESOLVED BY BROWARD COUNTY, FLORIDA, that: Section 1: That the foregoing "Whereas" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Section : That this document supports agenda Item #21, Emergency Management Division, approved on January 5, 2010 by the Broward County Commission adopting the multi -jurisdictional Local Mitigation Strategy ("LMS') Plan approved by the FEMA on December 10, 2009 as meeting all current requirements for such a plan. A copy of the signed Resolution is enclosed for your records. Chief Burton is your contact person at Tamarac Fire Rescue and you may contact him if you have questions or concerns.
