R-2010 - 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA TO PURCHASE FROM MOTOROLA, INC., UNDER BSO-MOTOROLA CONTRACT #07C-206, TEN (10) APX 700 DIGITAL PORTABLE RADIOS, BATTERIES, BATTERY CHARGERS AND RELATED ACCESSORIES FOR A TOTAL COST NOT TO EXCEED $47,107.70 IN FY10; TO COMPLETE ALL REQUIRED RADIO RE -BANDING AS OUTLINED IN THE BROWARD COUNTY AND SPRINT-NEXTEL AGREEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has provided high quality Fire Rescue operations to ' the community since 1975; and WHEREAS, Tamarac Fire Rescue desires to improve the quality of Fire and EMS operations to the residents, citizens and visitors of the City: and WHEREAS, on August 6, 2004, the Federal Communications Commission (FCC) issued a report and order that modified its rules governing the 800 MHz band to minimize harmful interference to public safety radio communications systems in the band (reconfiguration or rebanding); and WHEREAS, pursuant to FCC orders issued on December 22, 2004, Broward County Sheriff's Office (BSO) Communication Center and Sprint-Nextel were licensed on frequency allocations subject to reconfiguration; and WHEREAS, pursuant to FCC orders, Sprint-Nextel will pay for the cost of reconfiguration of the affected frequencies that Tamarac Fire Rescue utilizes as a user of ' BSO Communications Center, to enhance radio interoperability as part of its public safety Communications Center which supports county -wide police, fire and emergency services; and TR11784 Page 2 March 9, 2010 Revision #1 — March 12, 2010 WHEREAS, the reconfiguration program affects our public safety front-line firefighter ' radios and the purchase of ten (10) radios will be required to completed this program; and WHEREAS, the BSO and Motorola, Inc. agree to allow the City to utilize BSO- Motorola Contract #07C-206 pricing in an amount not to exceed $47,107.70; and WHEREAS, Article V "Purchasing Procedures", Section 6-155 of the City of Tamarac Code, "Waiver of Purchasing Procedures" permits the City to utilize agreements entered into by the U.S. Government or other governmental agencies without the requirement for additional formal competition; and WHEREAS, funding for the ten (10) APX radios has been provided for in the FY10 budget; and WHEREAS, the Fire Chief and the Purchasing and Contracts Manager recommend purchasing the ten (10) APX radios, batteries, battery chargers and accessories from ' Motorola, Inc. with pricing under the BSO-Motorola Contract #07C-206, in the amount not to exceed $47,107.70 in FY10 (attached hereto as Exhibit A); and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to purchase the APX radios and associated accessories in the amount not to exceed $47,107.70 from the Fire -Rescue FY10 budget. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: The appropriate City officials are hereby authorized to purchase the ten ' (10) APX radios, batteries, battery chargers and accessories from Motorola, Inc. with pricing 11 TR11784 Page 3 March 9, 2010 Revision #1 — March 12, 2010 under the BSO-Motorola Contract #07C-206, in the amount not to exceed $47,107.70 in FY10 (attached hereto as Exhibit A). SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution.
