R-2010 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ACCEPTING A GRANT AWARD IN THE AMOUNT OF $72,000 FROM THE U.S. DEPARTMENT OF HOMELAND SECURITY, FEDERAL EMERGENCY MANAGEMENT AGENCY ASSISTANCE TO FIREFIGHTERS GRANT PROGRAM; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A PROJECT AGREEMENT IN THE AMOUNT OF $90,000 BETWEEN THE U.S. DEPARTMENT OF HOMELAND SECURITY AND THE CITY OF TAMARAC FOR GRANT FUNDING IN THE AMOUNT OF $72,000 AND A 20 PERCENT MATCH OF $18,000 IN LOCAL FUNDS, TO PROVIDE FOR REIMBURSEMENT OF CONSTRUCTION COSTS FOR UPGRADES TO FIRE STATION #41; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac wishes to provide high quality Fire Rescue services to the residents, businesses and visitors to Tamarac; and WHEREAS, the City Commission of the City of Tamarac desires to protect the health and safety of Tamarac Fire Rescue personnel; and WHEREAS, the Federal Emergency Management Agency (FEMA), through the U.S. Department of Homeland Security (DHS), provides grants to local governments for modifications to fire rescue facilities through the Assistance to Firefighters Grant (AFG) Program; and WHEREAS, the City received a notice of award and agreement for a FEMA Assistance to Firefighters grant in the amount of $90,000 with a federal share of $72,000 and a required 20 percent match in local funds of $18,000 to provide for reimbursement of construction costs for upgrades to Fire Station #41, as indicated in the April 25, 2010 TR11826 Page 2 May 11, 2010 correspondence from DHS attached hereto as Exhibit A which is incorporated herein by this reference; and WHEREAS, construction costs for Fire Station #41 upgrades include but are not limited to costs for a generator, sprinkler system, and high -impact glass; and WHEREAS, the Fire Chief and Assistant City Manager recommend acceptance of these grant funds and execution of the project agreement between DHS and the City of Tamarac for reimbursement of construction costs for upgrades to Fire Station #41 in the amount of $90,000 pending legal review; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept this grant funding for reimbursement of construction costs for upgrades to Fire Station #41, and to execute the DHS project agreement for grant funding in the amount of $90,000, providing for an 80 percent federal share of $72,000 and a 20 percent match in local funds of $18,000. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution. All Exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2: The City Commission of the City of Tamarac HEREBY accepts the grant award of $72,000 from FEMA through DHS. Section 3: The appropriate City Officials are HEREBY authorized to accept the grant agreement between the City of Tamarac and DHS in the amount of $90,000, providing for an TR11825 Page 3 May 11, 2010 80 percent federal share of $72,000 and a required 20 percent match of $18,000 in local funds, hereto attached as Exhibit B which is incorporated herein by this reference. Section 4: An appropriation for the receipt and expenditure for this grant and any matching funds will be included in a budget amendment prior to November 30, 2010 pursuant to F.S. 166.241(2) Section 5: All Resolutions or parts of Resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. Section 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. Therefore, the grantee shall perform the work described in the approved grant application as itemized in the request details section of the application and further described in the grant application's narrative. These sections of the application are made a part of these grant agreement articles by reference. The grantee may not change or make any material deviations from the approved scope of work outlined in the above referenced sections of the application without prior written approval from FEMA. Article II - Grantee Concurrence By requesting and receiving Federal grant funds provided by this grant program, the grantee accepts and agrees to abide by the terms and conditions of the grant as set forth in this document and the documents identified below. The cost for micro -particle decontamination system and vertical lockers will not be funded. This line item has been removed from the budget. Article Vill - Financial Reporting The grantee must complete an on-line, semiannual financial status report to meet FEMA requirements. Semiannual financial reports are due within 30 days of the end of every six month period for the life of the grant. At the end of the performance period, or upon completion of the grantee's final program narrative, the grantee must complete an on-line final financial status report that is required to close out the grant. If a grantee's performance period is extended beyond the initial 12-month period, a periodic performance report is due every six month increment until closeout.
