CITY OF TAMARAC, FLORIDA
RESOLUTION NO.2010- 7L6
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA URGING THE BROWARD COUNTY
BOARD OF COUNTY COMMISSIONERS TO CONTINUE TO
FUND THE BROWARD SHERIFF'S REGIONAL CRIME
LABORATORY; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Florida Department of Law Enforcement (FDLE) operates Crime
Laboratories in Pensacola, Tallahassee, Jacksonville, Tampa Bay, Daytona, Orlando,
and Fort Myers; and
WHEREAS, none of the FDLE Crime Laboratories are in close proximity to
Broward County or the Southeast Florida region; and
WHEREAS, in 1969 the Sheriff of Broward County (Sheriff) opened a Regional
Crime Laboratory for the efficient, effective, and timely processing of forensic evidence
collected in crimes committed in Broward County due to the lack of close proximity and
timely response of an FDLE Crime Laboratory; and
WHEREAS, the State of Florida has funded only a small percentage of the costs
to operate the Sheriff's Regional Crime Laboratory thereby having Broward's residents
and visitors rely on the County Commission to fund the major portion of this essential
service; and

WHEREAS, having the Sheriffs Regional Crime Laboratory has proven valuable
and effective in the timely prosecution of crimes committed in Broward County with the
convictions of the guilty and the exoneration of the innocent; and
WHEREAS, the Broward County Board of County Commissioners (County
Commission) is seeking to no longer fund the Sheriff's Regional Crime Laboratory,
instead, looking to Broward County's municipalities and others to fund this regional
service or to close the Regional Crime Laboratory; and
WHEREAS, the County Commission is the governing body vested with the
responsibility to fund and provide regional services available to all Broward County
municipalities and their residents; and
WHEREAS, if the County Commission chooses to close the Regional Crime
Laboratory, it would be an abrogation of its responsibility to fund essential regional
services; would impede the effective and timely prosecution and defense of criminal
cases; would cause increased detention stays and costs; and would increase
opportunities for more crimes to occur in Broward County; and
WHEREAS, the County Commission's consideration to have Broward's
municipalities bear the costs of the Sheriffs Regional Crime Laboratory is inappropriate
as many crimes committed in Board County transcend municipal boundaries, with the
findings of the Regional Crime Laboratory are used by many parties, making the
assignment of costs both difficult and burdensome; and
WHEREAS, the City Commission of the City of Tamarac, Florida urges the
Broward County Board of County Commissioners to continue to fund the Broward
Sheriffs Regional Crime Laboratory.

NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS' clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution. All exhibits attached hereto are incorporated herein and made a specific
part of this resolution.
SECTION 2: The City Commission of the City of Tamarac, Florida hereby urges
the Broward County Board of County Commissioners to continue to fund the Broward
Sheriff's Regional Crime Laboratory.
SECTION 3: The City Clerk is hereby directed to transmit a copy of this
Resolution to the Broward County Board of County Commissioners, the Sheriff of
Broward County, the Broward State Attorney, the Public Defender of Broward County,
the Broward League of Cities and all municipalities in Broward County.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 6: This resolution shall become effective upon its passage and
