R-2010--4y RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING EXTENSION OF THE JOINT PARTICIPATION AGREEMENT WITH BROWARD COUNTY FOR HOUSEHOLD HAZARDOUS WASTE COLLECTION EVENTS VALID THROUGH AUGUST 5, 2011; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE SAID EXTENSION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Household Hazardous Waste (HHW) is currently collected every Saturday at drop-off sites in Pompano Beach, Hollywood, and Davie; and WHEREAS, data indicates that participation is greater when the distance to a drop-off site is minimal; and WHEREAS, the goal of this program is to bring the HHW service offered at the fixed sites to temporary remote collection locations for one day; and WHEREAS, the City of Tamarac has previously hosted a remote collection site to provide a more convenient opportunity to its residents who may not otherwise travel to the existing fixed sites; and WHEREAS, a Joint Participation Agreement (JPA) with Broward County of HHW collection events was approved on January 28, 2009 via Resolution R- 2009-12, a copy of which is incorporated herein by reference and on file in the Office of the City Clerk; and WHEREAS, the JPA will expire on August 5, 2010, and may be extended for up to three (3) additional one (1) year periods; and Temp. Reso. 11896 Page 2 of 3 June 22, 2010 WHEREAS, Broward County submitted written notice extending the JPA for HHW collection events, hereto attached as Exhibit 1; and WHEREAS, the Director of Public Works recommends that the City extend the JPA with Broward County for HHW collection events valid through August 5, 2011; and WHEREAS, the Mayor and City Commission of the City of Tamarac deem it to be in the best interest of the citizens and residents of the City of Tamarac that the extension of the JPA with Broward County for HHW Collection Events is hereby approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: The appropriate City Officials are HEREBY authorized to extend the Joint Participation Agreement with Broward County and the City of Tamarac for HHW Collection Events valid through August 5, 2011, hereto attached as Exhibit 2. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or Temp. Reso. 11896 Page 3 of 3 June 22, 2010 invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. The Agreement expires August 5, 2010, but may be extended for up to three (3) additional one (1) year periods. In accordance with Article 4.1, this letter constitutes written notice extending the Joint Participation Agreement through August 5, 2011, for its first additional one-year period, subject to the consent of your city. All other terms and conditions of the Joint Participation Agreement remain unchanged. We've attached the graphical usage data from your city's most recent event. As the host city, your residents realized greater convenience. Municipal based -information helped extend awareness and bolster participation.
