RESOLUTION NO. R-2009 -�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA ACCEPTING GRANT FUNDING IN THE
AMOUNT OF $66,000 FROM THE FEDERAL EMERGENCY
MANAGEMENT AGENCY (FEMA) ASSISTANCE TO
FIREFIGHTERS GRANT PROGRAM; AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A PROJECT
AGREEMENT BETWEEN THE U.S. DEPARTMENT OF
HOMELAND SECURITY AND THE CITY OF TAMARAC FOR
GRANT FUNDING IN THE AMOUNT OF $66,000 WITH A CASH
MATCH OF $16,500 IN CITY FUNDS FOR A GRANT TOTAL OF
$82,500, AND TO ENTER INTO THE NECESSARY
AGREEMENT FOR THE PURCHASE OF A MOBILE SELF-
CONTAINED BREATHING APPARATUS (SCBA) REFILLING
STATION FROM CHANNEL INNOVATIONS CORPORATION IN
THE AMOUNT OF $73,500; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac has provided high quality Emergency Medical
Services, including emergency medical transportation, to the community since 1996; and
WHEREAS, the City Commission desires to protect the health and safety of City fire
rescue personnel; and
WHEREAS, the Federal Emergency Management Agency (FEMA), through the U.S.
Department of Homeland Security (DHS), provides grants to local governments for the
acquisition of fire apparatus and equipment through the Assistance to Firefighters Grant
(AFG) Program, and
WHEREAS, the City was awarded a Federal Emergency Management Agency
Assistance to Firefighters grant in the amount of $66,000 to purchase a mobile SCBA
refilling station ($48,000) and cylinders ($18,000) as indicated in the grant application and

the January 9, 2009 correspondence from DHS, attached hereto as Exhibits A and B
respectively; and
WHEREAS, the City of Tamarac Fire Rescue system evaluated several mobile SCBA
units, including a possible rescue retrofit, resulting in the selection of the Mako SCBA
refilling station; and
WHEREAS, the City of Clearwater, Florida recently solicited a formal competitive
Request for Bid (RFB#30-08, July 2, 2008) for the purchase of an SCBA refilling station, and
successfully awarded an Agreement for a Mako SCBA refilling station to Channel Innovation
Corporation in the amount of $73,500.00, attached hereto as Exhibits C, D and E; and
WHEREAS, Article V "Purchasing Procedures", Section 6-155 of the City of Tamarac
Code, "Waiver of Purchasing Procedures" permits the City to utilize agreements entered
into by the U.S. Government or other governmental agencies without the requirement for
additional formal competition; and
WHEREAS, the City of Clearwater, Florida and Channel Innovation Corporation agree
to allow the City to utilize this agreement at the original pricing of $73,500; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of Tamarac Fire Rescue to use the City of Clearwater Request for Bid (RFB#30-08,
July 2, 2008) to purchase the mobile SCBA refilling unit from Channel Innovation
Corporation to enhance overall fire scene effectiveness, attached hereto as Exhibits C, D
and E; and
WHEREAS, the granting agency requires that the City match the 2009 Assistance to
Firefighters Grant Program request of $66,000 with a 20% cash match in City funds in the
amount of $16,500, for a total grant amount of $82,500; and
WHEREAS, funding for the cash match for the mobile SCBA refilling station has been
provided for the total project costs in the FY09 Fire Rescue budget; and

WHEREAS, acceptance of these grant funds requires the amending of estimated
revenues and expenditures within the Grants Fund Budget; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of the citizens and residents of the City of Tamarac to accept this grant funding for
the provision of a mobile SCBA refilling station and cylinders from FEMA, and to execute the
DHS project agreement for grant funding in the amount of $66,000, providing a 20% cash
match in City funds of $16,500 for a grant project cost of $82,500; and
WHEREAS, the Assistant City Manager, the Interim Fire Chief, and the Purchasing
and Contracts Manager recommend acceptance of these grant funds and execution of the
project agreement between DHS and the City of Tamarac, and to enter into the necessary
agreements with Channel Innovations Corporation for the purchase of a mobile SCBA
refilling unit in a total amount not to exceed $73,500, pending legal review and approval.
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as
being true and correct and are HEREBY made a specific part of this Resolution. All Exhibits
attached hereto are incorporated herein and made a specific part of this Resolution.
Section 2: The City Commission of the City of Tamarac HEREBY accepts the award
of $66,000 from FEMA through DHS.
Section 3: The appropriate City Officials are HEREBY authorized to accept the Grant
Agreement between the City of Tamarac and DHS in the amount of $66,000 with a 20%
cash match of $16,500 in City funds for a grant project cost of $82,500 (attached hereto as
Exhibit A), approval letter (attached hereto as Exhibit B), vendor quotation (attached hereto
as Exhibit C), City of Clearwater RFB #30-08 (attached hereto as Exhibit D) and award letter
to Channel Innovations Corporation (attached hereto as Exhibit E), and to enter into the
necessary agreements pending legal review and approval between the City of Tamarac and
Channel Innovations Corporation for the SCBA refilling unit.

Section 4: The appropriate City Officials are HEREBY authorized to amend the Grants
Fund budget in the amount of $66,000 and appropriate said funds including any and all
subsequent budgetary transfers to be in accordance with proper accounting standards.
Section 5: The appropriate City Officials are HEREBY authorized to enter into the
necessary agreements with Channel Innovations Corporation for the purchase of a mobile
SCBA unit in the amount of $73,500.
Section 6: All Resolutions or parts of Resolutions in conflict herewith are HEREBY
repealed to the extent of such conflict.
Section 7: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it
shall not affect the validity of the remaining portion or applications of this Resolution.
Section 8: This Resolution shall become effective immediately upon its passage and
adoption.

1) PROJECT DESCRIPTION AND BUDGET
After performing a risk and needs assessment, Tamarac Fire Rescue determined our greatest risks and needs
to be the purchase of equipment and materials necessary to outfit a portable Self Contained Breathing
Apparatus (SCBA) refilling station capable of supporting the Department's emergency operations. The SCBA
unit would be useful for firefighting, hazardous materials, dive rescue, weapons of mass destruction and other
special operations incidents such as confined space and technical rescue incidents.
This essential equipment is critical for the Department because our current breathing air refilling system is over
15 years old. The current system is undependable due to the extended periods of time the unit is out of service,
and/or frequent repair costs that do not make fiscal sense. Despite annual repair and maintenance costs for the
machine at approximately $10,000, the unit continues to be out of operation about three months out of the year.
In addition, the existing equipment is not capable of refilling multiple compressed air breathing cylinders in a time
frame suitable to meet the demands of the Department. Finally, the existing stationary unit requires depleted air
cylinders to be transported back to a fire rescue station for refilling. This additional step requires first response
units to leave their primary territory and remain out of service for extended periods of time while cylinders are
refilled.
In addition to improving Tamarac Fire Rescue's ability to remotely refill breathing air cylinders, the Department
must ensure that ample spare air cylinders are available for all emergency responders. The Department
currently possesses approximately 90 SCBA units and 125 air cylinders. Fifty of these air cylinders are at least
nine years old, and 25 cylinders have at least 13 years. Since current regulations allow a maximum service life
of 15 years, it is necessary to purchase 25 new 30-minute breathing air cylinders to outfit all operational units
with at least one spare cylinder per emergency responder. These replacements and the mobile air refilling
station will ensure an adequate supply of breathable air is maintained on the scene of an emergency incident. It
is the intent of the program to outfit the portable Self Contained Breathing Apparatus (SCBA) refilling station with
these cylinders for rapid deployment in the event of a large-scale incident. The cost of these cylinders is
approximately $25,000.
Keeping with Tamarac Fire Rescue's Business Plan, the Department's Training & Safety Officer (a 2004 grant
awarded position) would develop a comprehensive training program on the proper operations, safety and
maintenance requirements for the proposed unit. The cost of the unit is approximately $115,000

2) FINANCIAL NEED
The population of Tamarac has increased dramatically over the last ten years, making it the 36th largest city in
Florida and the 11th largest city in Broward County. However, with recent state budget reductions and potentially
more on the way, current staffing was reduced by five firefighter positions to a total of 99.
The recent loss of property tax revenue continues to challenge the financial and logistical resources of the City.

funding the necessary services to ensure the safety of fire rescue personnel and the public. If this proposal is
funded, the City is committed to the 20% cash match requirement for items outlined in the project budget as well
as funding the required training and long term maintenance of the equipment.

3) BENEFIT DERIVED FROM PROJECT COST
Tamarac Fire Rescue provides emergency medical services (EMS) and fire suppression activities for 59,000
residents, 2,000 businesses, and automatic and mutual aid to several surrounding communities. Tamarac Fire
Rescue has grown tremendously over the last seven years and doubled in size between 1996 and 2002
including an annexation. The growth in the department is directly related to the growth in the number of calls,
which increased from 6,500 calls per year in 1997 to over 11,000 calls per year in 2007. These calls included
1,250 incidents involving potentially hazardous atmospheres that required the use of a self contained breathing
apparatus (SCBA) or a self contained underwater breathing apparatus (SCUBA). This rapid expansion has
challenged the department's ability to equip and support personnel with the necessary equipment with existing
funds and resources.
Tamarac is interlaced with over 640 acres of canals. With a growing population, these waterways will continue to
present opportunities for water -related accidents and/or drowning incidents. Consequently, the Fire Rescue
Department instituted a new Underwater Dive Rescue Team for 2004. However, the Department is still not
capable of supporting operations that require lengthy on -scene times that require on -site breathing air refilling.
The addition of a portable SCBA refilling station will improve the Department's ability to operate for prolonged
periods of time at large-scale incidents and during EOC activation.
In addition, Tamarac Fire Rescue participates in the Broward County and Florida Statewide Mutual Aid plans
which are deployed during large-scale events such as structure fires, dive rescue emergencies, terrorism
events, hazardous materials incidents and regional responses to the Broward County international air and sea
ports. The westernmost border of Tamarac is the Everglades Water Conservation Area 2a. The Conservation
Area is in the flight path for the Fort Lauderdale/Hollywood International Airport and Tamarac would be called
upon to respond in the event of a downed aircraft. During the past two years, Tamarac Fire Rescue was called
upon to render assistance during a series of wildfires that erupted throughout the area as well as the 2004 and
2005 hurricane events which required deployment under the Statewide Mutual Aid Plan. This equipment would
further serve to provide long term support to the firefighters operating at these events.
The cost for this unit is $115,000 and will be available to all responders throughout the City. The unit will also be

4) HOW PROJECT WILL ASSIST DAILY OPERATIONS AND PROTECT LIFE AND PROPERTY
Tamarac Fire Rescue is committed to providing emergency responders with the essential life safety equipment
and necessary training that they need on a continual basis. Moreover, the City is dedicated to providing effective
and efficient emergency responses to incidents occurring in Tamarac, its immediate neighbors, and
municipalities Statewide. Tamarac has Mutual Aid Agreements with North Lauderdale, Lauderdale Lakes and
Lauderhill, adding 41,000, 31,826, and 59,621 residents respectively to its safety commitment.
Tamarac Fire Rescue has identified the requested equipment as critical to the success of the City's Strategic
Plan. As part of the Tamarac Fire Rescue Business Plan, funding from this grant will secure necessary
equipment and response times to the City's emergency responders. The plan is designed to ensure ongoing
compliance with the statutory requirements outlined by the Occupational Safety and Health Administration
(OSHA) 1910.134 and Rule 308-134e, and Florida Statutes Sec. 633.801 ; 633.821. The portable Self
Contained Breathing Apparatus (SCBA) refilling station will allow efficient operations at the scene of fire rescue
emergencies because the system will allow emergency responders to be self sustained and will ensure
adequate breathing air is available during structure fires, hazardous materials incidents, and dive rescue
emergencies, as well as large-scale, long-term incidents such as terrorism events, or other emergencies
involving hazardous atmospheres that require the use of self contained breathing apparatus.
Tamarac is able to continue this commitment only through support of City and alternative funding sources such
as this application. It is the intent of the Department to continuously build upon previous grant awards and
funding sources that support the intent of past, present and future funding requests. Without the support of local,
State and Federal assistance, this project and previous ones would not be feasible. Reviews of previous
programs demonstrate the departments intention to initiate and continue valuable strategic programs such as
this request.
Enhancing the 2002 Award
In 2002, the City was honored to be awarded a FEMA Assistance to Firefighters grant to purchase additional
Scab's for the entire Department, which the Department had not previously owned. The additional SCBA
equipment purchased allows the Department to equip every emergency response unit with this essential
equipment. In the past, there were not enough Scab's for all personnel. This year's proposed project will help
ensure that Tamarac Fire Rescue personnel are equally prepared and equipped for a variety of emergency
scenarios including the protection and rescue to their own health and safety as well as that of the public.
Enhancing the 2003 Award
In 2003 the City was awarded a FEMA Assistance to Firefighters grant for the purpose of improving the
Department's training by dedicating a person to conduct one year of comprehensive firefighter training. The City
has continued its commitment to provide high quality training and permanently funded this program. This Safety
and Training Officer is continually available to develop comprehensive training programs and coordinates off -site
facility training of the personnel.
Enhancing the 2004 Award
The Department was honored in 2004 to be awarded a FEMA Assistance to Firefighters grant for the purpose of
adequately outfitting Rapid Intervention Teams (RIT) with the necessary equipment needed to effectively
respond to situations of trapped or missing firefighters at the scene of structure fires or incidents that adversely
affect emergency responders.

The purpose of the Assistance to Firefighters Program is to protect the health and safety of the public and
firefighting personnel against fire and fire -related hazards. After careful consideration, DHS has determined that
the grantee's project submitted as part of the grantee's application, and detailed in the project narrative as well
as the request details section of the application - including budget information - was consistent with the
program's purpose and worthy of award. Therefore, the grantee shall perform the work described in the
approved grant application as itemized in the request details section of the application and further described in
the grant application's narrative. These sections of the application are made a part of these grant agreement
articles by reference. The grantee may not change or make any material deviations from the approved scope of
work outlined in the above referenced sections of the application without prior written approval from DHS.

Article 11- Grantee Concurrence
By requesting and receiving Federal grant funds provided by this grant program, the grantee accepts and agrees
to abide by the terms and conditions of the grant as set forth in this document and the documents identified
below. By receiving funds under this grant, grantees agree that they will use the funds provided through the
Fiscal Year 2008 Assistance to Firefighters Grant Program in accordance with these Articles of Agreement and
the program guidelines provided in the Fiscal Year 2008 Assistance to Firefighters Grants program guidance.
The grantee agrees that Federal funds under this award will be used to supplement, but not supplant, State or
local funds for first responder preparedness. All documents submitted as part of the application are made a part
of this agreement by reference.
Article III - Period of Performance
The period of performance shall be from 11-DEC-08 to 10-DEC-09.
The grant funds are available to the grantee for obligation only during the period of performance of the grant
award. The grantee is not authorized to incur new obligations after the expiration date unless the grantee has
requested, and DHS has approved, a new expiration date. The grantee has 90 days after period of performance
to incur costs associated with closeout or to pay for obligations incurred during period of performance. Award
expenditures are for the purposes detailed in the approved grant application only. The grantee cannot transfer
funds or assets purchased with grant funds to other agencies or departments without prior written approval from
DHS.

The amount of the award is detailed on the Obligating Document for Award attached to these articles. Following

Article V - Requests for Advances or Reimbursements
Grant payments under the Assistance to Firefighters Grant Program are made on an advance or reimbursable
basis for immediate cash needs. In order to request funds, the grantee must logon to the Fire Grant System
using their user id/password (used to submit the application) the grantee fills out the on-line Request for
Advance or Reimbursement. If an authorized user needs access to the application but does not have the user id
or password, they may be obtained by calling the help desk at 1-866-274-0960.
With prior DHS approval, grantees may make changes in funding levels between the object classes (as detailed

in Article IV above), in order to accomplish the grant's scope of work. The grants scope of work is outlined in the
project narrative and in the request details of the grant application. The provisions of this article are not
applicable to changes in the budgeted line -items listed in the request details section of the application as the
line -items in the request details section (i.e., scope of work) cannot be changed.
Article VII - Financial Reporting
The Request for Advance or Reimbursement mentioned above will also be used for interim financial reporting
purposes. At the end of the performance period, or upon completion of the grantee's program narrative, the
grantee must complete, on-line, a final financial report that is required to close out the grant. The Financial
Status Report is due within 90 days after the end of the performance period.
Article Vlll - Performance Reports
The grantee must submit a semi-annual and a final performance report to DHS. The final performance report
should provide a short narrative on what the grantee accomplished with the grant funds and any benefits derived
there from. If a grantee's performance period is extended beyond the initial 12-month period, a periodic
performance report is due every six month increment until closeout.
Article IX - DHS Officials
Program Officer: Tom Harrington, Deputy Director of the Grants Program Office, is the Program Officer for this
grant program. The Program Officer is responsible for the technical monitoring of the stages of work and
technical performance of the activities described in the approved grant application.
Grants Assistance Officer: DONNA SIMMONS is the Assistance Officer for this grant program. The
Assistance Officer is the Federal official responsible for negotiating, administering, and executing all grant
business matters.
Grants Management Branch POC: Jacqueline Lee is the point of contact for this grant award and shall be
contacted for all financial and administrative grant business matters. If you have any questions regarding your

Article X - Other Terms and Conditions
A. Pre -award costs directly applicable to the awarded grant are allowable if approved in writing by the DHS
program office. In order to be reimbursed for items purchased prior to award, grantees must submit a payment
request and provide rationale for incurring the costs prior to award. All pre -award expenses should have been
disclosed during the award negotiation process. Failure to disclose pre -award expenses during the award
negotiation process may affect the costs' eligibility.
B. Quotes obtained prior to submittal of the application - for the purposes of applying for this grant - are not
considered to be sufficient to satisfy the requirements for competition as outlined in OMB Circular A-110 below.
All bidding activities implemented for competition must be sought and obtained after award, i.e., during the
period of performance. Grantees may be jeopardizing their awards if the requirements set forth are not adhered
to.

Article XII- Audit Requirements
All grantees must follow the audit requirements of OMB Circular A-133, Audits of States, Local Governments,
and Non -Profit Organizations. The main requirement of this OMB Circular is that grantees that expend
$500,000.00 or more in Federal funds (from all Federal sources) must have a single audit performed in
accordance with the circular.
As a condition of receiving funding under this grant program, you must agree to maintain grant files and
supporting documentation for three years upon the official closeout of your grant. You must also agree to make
your grant files, books, and records available for an audit by DHS, the General Accounting Office (GAO), or their
duly authorized representatives to assess the accomplishments of the grant program or to ensure compliance
with any requirement of the grant program.
Article XIII- Additional Requirements (if applicable)
Vehicle Awardees:
Vehicle awardees for FY 2008 will be required to include an advance payment bond as part of the contract with
their vehicle manufacturer. An advance payment bond is like an insurance policy that protects you in the event
that the manufacturer with whom you contracted to build your vehicle cannot fulfill the contract, i.e., cannot finish
building your vehicle for any reason. An advance payment bond is a financial tool used to guarantee that, in the
event of manufacturer/contractor default, funds will be available to finish the construction of your vehicle and
ensure its proper operation. From the vehicle grantee's point of view, the insolvency of a contractor during the
construction of a vehicle will most likely result in delayed completion of the vehicle, additional expenses for a
different manufacturer/contractor to finish the work, or even loss of grant funds. For this reason, we now require
manufacturers/contractors to provide a bond from an independent bank, insurance company or bonding agency
so that the vehicle grantees can recover damages they may sustain if the manufacturer/contractors default
during the construction of a vehicle. The amount of the bond should be equal to, or greater than, the sum of any
payments, compensation and/or consideration provided prior to the delivery of the vehicle. If no down payment
is required in the purchase contract, an advance payment bond is not required.

vendor. If the vendor does not deliver the vehicle by the date stipulated in the performance clause, penalties are
administered to the vendor. These penalties should be of a severity sufficient to provide the vendor with
incentive to deliver the vehicle at the earliest possible date but no less than $100 per day.
Regional Hosts:
Grantees that are the hosts of regional projects as provided for in the annual program guidance are accountable
for the equipment purchased with grant funds and disbursed to other first -responder organizations under a
memorandum of understanding. Responsibility for maintenance of the equipment may be placed in the hands of
the recipient if specifically delineated in the memorandum of understanding between the host and the recipient.
Modification to Facilities Requirements:
Modification to facility projects (including renovations associated with equipment installations) are subject to all
applicable environmental and historic preservation requirements. Applicants seeking assistance to modify their
facilities or to install equipment requiring renovations may undergo additional screening. Specifically, DHS is
required to ascertain to what degree the proposed modifications and renovations might affect an applicant's
facility relative to the National Environmental Policy Act, National Historic Preservation Act of 1966, National
Flood Insurance Program regulations, and any other applicable laws and Executive Orders. No project that
involves a modification to facility can proceed — except for project planning — prior to formal written approval from
DHS. If your award includes a modification to a facility, you are responsible for contacting the Program Office so
you can be given direction on how to proceed; your contact in the AFG Program Office is
Stephen. pezzetti@dhs.gov. Noncompliance with these provisions may jeopardize an applicant's award and
subsequent funding.
Grants Management Adjustments to Original Application (if applicable):
This grant award was reduced by $57,500. The approved amount for cascade fill station is $60,000 not
$115,000. The approved amount for spare cylinders is $900 not the $1,000 indicated in the initial application.
The reduction has already been made in the grant award and in the application as agreed by Tom Sheridan via
email 11/21/08. The total project cost was reduced from $140,000 to $82,500. The federal share was reduced
from $112,000 to $66,000. The applicant share was reduced from $28,000 to $16,500.
