RESOLUTION NO. R-2009- / I
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO APPROVE A REFUND IN THE AMOUNT
OF TWELVE THOUSAND NINE HUNDRED FOURTEEN
DOLLARS AND THIRTY-ONE CENTS ($12,914.31) WHICH
WAS PAID ON COMMERCIAL ALTERATION PERMIT
NUMBER 07-4981; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac received requests from Starbucks Coffee
Company, Pemberton Building, Inc., and Site Data, attached hereto as Exhibit 1,
requesting reimbursement for fees paid on commercial alteration permit for the property
located at 10201 West Commercial Blvd., permit 07-4981; and
WHEREAS, the Chief Building Official and Director of Community Development
recommend the refund of $12,914.31 for fees associated with permit 07-4981 as identified
in the spreadsheet attached hereto as Exhibit 2; and
WHEREAS, available funds exist in the accounts 001-0000-369-9000; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to refund $12,914.31 in Building Permit and associated fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
All exhibits referenced herein and attached hereto are hereby incorporated herein by this
reference.
SECTION 2: That the request to refund $12,914.31 in Building Permit and
associated fees, is HEREBY APPROVED.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its passage
and adoption.
