R-2009 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE CHANGE ORDER NO.2 TO THE AGREEMENT WITH STRAIGHTLINE ENGINEERING GROUP, INC. FOR THE RENOVATION OF THE BOAT RAMP AT VETERANS PARK FOR AN AMOUNT NOT TO EXCEED $ 48,584 FROM THE APPROPRIATE ACCOUNTS; AUTHORIZING BUDGET AMENDMENTS AS NEEDED FOR PROPER ACCOUNTING PURPOSES PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac currently maintains approximately 600 acres of canals and waterways; and WHEREAS, the City maintains the boat ramp located at Veteran's Park in the City of Tamarac; and WHEREAS, the current condition of the existing ramp does not safely accommodate full sized trailers and boats; and WHEREAS, renovation of the existing boat ramp site, including demolition and disposal of the existing boat ramp, and installation of a new ramp will encourage the safe use of this boat ramp and the surrounding park and recreation areas; and WHEREAS, on July 11, 2007, via Resolution R-2007-112, the City Commission approved award of RFP Number 07-20R for design/build of the Boat Ramps Project, incorporated herein by reference and on file in the office of the City Clerk; and Temp. Reso: 11680 August 24, 2009 Page 2 of 4 WHEREAS, the City of Tamarac has negotiated Change Order Number 2 (two) with STRAIGHTLINE ENGINEERING GROUP, INC. attached hereto as Exhibit 1" for their services at a cost not to exceed $ 48,584, and WHEREAS, the City of Tamarac was awarded a grant in the amount of $48,584 from The Broward County Marine Advisory Committee Broward Boating Improvement Program; and WHEREAS, Change Order Number 2 with Straightline Engineering Group, Inc. will be issued pending full execution of the grant agreement by Broward County, and notice to proceed is issued from the County. Construction of the Boat ramp will begin once receipt of final construction drawings are reviewed and approved by the Broward County Marine Advisory Committee. A copy of the notice of award is hereto attached as "Exhibit 2"; and WHEREAS, it is the recommendation of the Director of Public Works and the Purchasing and Contracts Manager that Change Order Number 2 to the Agreement with STRAIGHTLINE ENGINEERING GROUP, INC. for the renovation of the boat ramp at Veteran's Park be approved; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve Change Order No. 2 to the Agreement with STRAIGHTLINE ENGINEERING GROUP, INC. at a cost not to exceed $ 48,584. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: I C Temp. Reso: 11680 August 24, 2009 Page 3 of 4 SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: The appropriate City Officials are HEREBY authorized to approve Change Order 2 to the Agreement with STRAIGHTLINE ENGINEERING GROUP, INC., in an amount not to exceed $48,584, hereto attached as Exhibit 1. SECTION 3: All budget amendments for proper accounting purposes are hereby authorized. SECTION 4: All Resolutions or parts of Resolutions in conflict hecewsjth are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable. Attached is the BBIP Project Ranking Scores tally sheet for your files. This MAC recommended BBIP project will be included in the Broward County Fiscal Year 2009/2010 Budget, which will be approved by the Board ofCounty Commissioners during the annual budget public hearings in September 2009. The continuation of the BBIP process will require the execution ofan Agreement between the County and the City, The City will receive the Standard Form BBIP Agreements for execution by the City in the middle of the summer. The fully executed BBIP Agreement will be sent to the City in October, with a "Notice to Proceed," Invoices dated before the Agreement is fully executed will not be eligible for reimbursement, Also, Final construction drawings must be approved by the MAC before construction begins. This is to ensure that the project submitted to the MAC is the same project that is constructed. When the drawings are complete, please let me know so I can schedule the review of the plans by the MAC. We look forward to working with you and the City of Tamarac on this project.
