CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2009- 1a'7
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, DESIGNATING KSM ELECTRONICS,
INC.'S RELOCATION TO THE WESTPOINT CENTRE AT
THE TAMARAC COMMERCE PARK AS AN ECONOMIC
DEVELOPMENT PROJECT OF THE CITY OF TAMARAC;
APPROVING AN ECONOMIC DEVELOPMENT PERMIT
FEE WAIVER NOT TO EXCEED 15% OF THE TOTAL
BUILDING PERMIT FEES UP TO $10,000; AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO TAKE ALL
NECESSARY ACTIONS TO EFFECTUATE THE INTENT
OF THIS RESOLUTION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, economic welfare is one of the main concerns of a modern city;
WHEREAS, the Mayor and City Commission have long recognized the
importance of the Tamarac Commerce Park to the economic vitality of the City; and
WHEREAS, the City was contacted by Steven Benjamin, President, KSM
Electronics, Inc. regarding the potential of moving their South Florida operations to
the Westpoint Centre; and
WHEREAS, the Public and Economic Affairs Officer met with representative
of KSM Electronics, Inc. to determine if the City could assist in the company's desire
to relocate to the City of Tamarac; and

WHEREAS, after meeting and discussions, the Public and Economic Affairs
Officer concluded that it would be in the City's interest to assist KSM Electronics,
Inc. with relocation to the City of Tamarac; and
WHEREAS, the relocation of KSM Electronics, Inc. will encourage the
economic revitalization of the City of Tamarac by providing employment for one -
hundred twenty (120) employees; and
WHEREAS, KSM Electronics, Inc. will stimulate the City's economy by
contributing to the utilization of local housing and commercial establishments; and
WHEREAS, utilization of local housing and commercial establishments will
result in additional property tax revenue to the City; and
WHEREAS, the relocation of KSM Electronics, Inc. to the City of Tamarac will
stimulate additional economic development in the City which will ultimately result in
increased property taxes to the City from the Westpoint DRI; and
WHEREAS, the City of Tamarac will realize revenue from real property
improvements which would not have been made but for the relocation of KSM
Electronics, Inc. to the City of Tamarac; and
WHEREAS, City of Tamarac Ordinance No. 0-2000-13 (a copy of said
Ordinance is on file in the Office of the City Clerk) previously authorized the waiver
of certain fees for economic development purposes pursuant to a Development
Agreement between West Point Land, L.L.0 and the City of Tamarac; and

WHEREAS, the Development Agreement provides for the reduction of
building permit fees for qualified economic development projects; and
WHEREAS, the City has previously offered incentives to companies located
within the Westpoint Centre at the Tamarac Commerce Park; and
WHEREAS, it is the recommendation of the Public and Economic Affairs
Officer that the City Commission recommend certain review and building permitting
fees be waived in an amount not to exceed 15% of total Building Permit fees up to
$10,000; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to
be in the best interest of the citizens and residents of the City of Tamarac to approve
an Economic Development Incentives in an amount not to exceed 15% of total
building permit fees up to $10,000, including designation as an Economic
Development Project for the purpose of expedited permitting and fee waivers for
KSM Electronics, Inc. to relocate to the Westpoint Centre at the Tamarac Commerce
Park.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this
Resolution.

SECTION 2: The City Commission of the City of Tamarac, Florida
HEREBY recognizes the importance of economic development and the need to offer
incentives to stimulate such development and designates the KSM Electronics, Inc.
relocation project as an Economic Development project of the City of Tamarac.
SECTION 3: The City Commission HEREBY authorizes the waiver of
various review and permit fees, in an amount not to exceed 15% of total Building
Permit fees up to a maximum limit of $10,000.
SECTION 4: The City Manager, or his designee, is HEREBY
authorized to take any and all actions necessary to effectuate the intent of this
resolution.
SECTION 5: All resolutions or parts of resolutions in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.
