R-2009- 1,9Y A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, REQUESTING THAT THE CITY ADOPT GREEN STANDARDS FOR NEW AND SUBSTANTIALLY RENOVATED GOVERNMENT BUILDINGS (CASE NO. 27-MI-09); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Whereas, the City of Tamarac, Florida is currently applying for the Gold Certification level for the Florida Green Local Government from the Florida Green Building Council (FGBC); and WHEREAS, one of the criteria that the City is striving to meet is to adopt a green standard as official minimum criteria for new or substantially renovated government buildings.; and WHEREAS, to attain the points for this criteria, the City must adopt through resolution, support of Florida State Statute 255.2575 "Energy -Efficient and Sustainable Buildings"; and WHEREAS, the adoption of this resolution will declare that there is an important interest in promoting the construction of energy -efficient and sustainable buildings. This action will demonstrate the City's commitment to energy conservation, saving taxpayer's money and raising public awareness of energy rating systems, and WHEREAS, the City Commission of the City of Tamarac finds that approving the resolution for the Green Building Standard would be in keeping with the public health, safety and general welfare of the City of Tamarac; and Temp Reso #11703 October 19, 2009 Page 2 WHEREAS, the Director of Community Development recommends approval of this resolution; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac, Florida to adopt by resolution a green building standard for new and substantially renovated government buildings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the Resolution adopting a green building standard for new and substantially renovated government buildings is HEREBY APPROVED. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
