RESOLUTION NO. f
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, CALLING AND PROVIDING FOR A SPECIAL
MUNICIPAL ELECTION TO BE HELD ON THE Ile DAY OF
DECEMBER, 2009, TO PROVIDE FOR THE' ELECTION OF AN AT -
LARGE MAYOR; PROVIDING FOR TIMES OF SAID ELECTION;
AUTHORIZING THE EXPENDITURE. BY THE CITY TO COVER THE
COSTS OF THE ELECTION; PROVIDING FOR A QUALIFYING
PERIOD; PROVIDING FOR POLLING PLACES; DIRECTING THE CITY
ADMINISTRATION TO TAKE ANY AND ALL STEPS NECESSARY TO
EFFECTUATE THE INTENT OF THIS RESOLUTION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the election for at -large mayor of the City of Tamarac, Florida (the
"City") was scheduled for November 3, 2009; and
WHEREAS, two (2) of the three (3) candidates who qualified for the November 3,
2009 mayoral election have withdrawn from the race creating a vacancy in candidacy
pursuant to Section 166.031, F.S.; and
WHEREAS, in accordance with Section 166.031, F.S., the City adopted an
ordinance addressing vacancies in candidacy and, since there are less than forty-five
(45) days between the vacancy and the November 3, 2009 election, the City must
reschedule the mayoral election for no less than forty-five days nor more than sixty (60)
days from November 3, 2009; and
WHEREAS, after coordinating with the Broward County Supervisor of Elections,
the City administration has recommended holding the rescheduled election on
December 18, 2009; and

WHEREAS, pursuant to the City's adopted procedures, the qualifying period for
the special mayoral election shall be from October 29, 2009 through November 4, 2009;
and
WHEREAS, the City Commission understands and acknowledges that the City
shall be responsible for bearing the cost of the special mayoral election; and
WHEREAS, the City Commission, in accordance with its adopted practices and
procedures, finds that conducting an special election for an at -large mayor on
December 18, 2009 is in the best interest of the citizens and residents of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are true and correct and
expressly made a part hereof.
Section 2: That the City Commission of the City of Tamarac, Florida hereby
calls for a Special Municipal Election for an at -large mayor to be held on the 18t' day of
December 2009.
Section 3: That in accordance with the requirements of the Florida Election
Code, the polls shall be open to voters from 7:00 am until 7:00 pm on the date of the
election.
Section 4: That, in accordance with the City's Charter, Code of Ordinances,

and the Florida Election Code, qualifying for candidates shall begin at noon on October
29, 2009 and end at noon on November 4, 2009.
Section 5: That the City Commission hereby authorizes the City expend the
funds necessary to hold the Special Municipal Election for mayor as set forth herein.

Section 6: That the City Commission hereby authorizes and directs
appropriate members of the City Administration to take any and all steps necessary to
effectuate the intent of this resolution.
Section 7. All resolutions inconsistent or in conflict herewith shall be and are
hereby repealed insofar as there is conflict or inconsistency.
Section 8. If any section, sentence, clause, or phrase of this resolution is held
to be invalid or unconstitutional by any court of competent jurisdiction, the"- aid holding
shall in no way affect the validity of the remaining portions of this resolution.
Section 9. This resolution shall become effective upon its passage and
adoption by the City Commission.
