R-2009- �7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A SPECIAL EXCEPTION TO ALLOW THE OPERATION OF AN "ACCESSORY TRUCK RENTAL" OPERATION LOCATED AT 8267 N.W. 88T" AVENUE SPECIFICALLY A PORTION OF PARCEL "A" OF TAMARAC TOWN SQUARE, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 112 PAGE 1 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (CASE NO. 4-Z-09); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Code of Ordinances of the City of Tamarac provides for the granting of a special exception to allow the operation of an "Accessory Truck Rental' operation in a B-3 (General Business District) zoning category located at 8267 N.W. 88th Avenue, specifically a portion of Parcel "A" of Tamarac Town Square, according to the Plat thereof as recorded in Plat Book 112, Page 1 of the Public Records of Broward County, Florida; and WHEREAS, the proposed Special Exception is consistent with the adjacent residential neighborhoods relative to the proposed intensity, building mass, and aesthetic impact of the requested use; and WHEREAS, the Director of Community Development recommends approval of this application; and Temp Reso #11616 October 19, 2009 1 st Revision - 10/20/09 Page 2 u WHEREAS, the Planning Board recommended approval of this application, at its October 7, 2009 meeting; and WHEREAS, the City Commission of the City of Tamarac finds that granting the petition for Special Exception with the conditions stated below, would be in keeping with the public health, safety and general welfare of the City of Tamarac; and Conditions of Approval: 1. All rental trucks shall be stored in the southern portion of the rear parking lot only. 2. Drop-off for all rental trucks shall be in the southern portion of the rear parking lot only and the customer's contract be maintained with the following language: Trucks must be parked where they were originally picked up (at the south end in the rear of the shopping center) a $100.00 fee will be added to your contract if the trucks are parked anywhere else. 3. The southern perimeter hedge shall be maintained in a continuous healthy, manner at all times. 4. The approval of the Special Exception shall be for this existing applicant only. 5. Staff will monitor the adherence of the above conditions to ensure compliance and reserve the right to void the approval of the Special Exception if compliance is not maintained. 6. The maximum number of rental trucks parked in the rear of this property shall not exceed 10 trucks at any given time. J Temp Reso #11616 October 19, 2009 1 St Revision - 10/20/09 Page 3 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this Special Exception to allow the operation of an "Accessory Truck Rental" operation in a B-3 (General Business District) zoning category located at 8267 N.W. 88th Avenue, specifically a portion of Parcel "A" of Tamarac Town Square, according to the Plat thereof as recorded in Plat Book 112, Page 1 of the Public Records of Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the Petition for special exception to allow the operation of an "Accessory Truck Rental" in a B-3 (General Business District) zoning category located at 8267 N.W. 88th Avenue specifically a portion of Parcel "A" of Tamarac Town Square, according to the Plat thereof as recorded in Plat Book 112, Page 1 of the Public Records of Broward County, Florida, is HEREBY APPROVED subject to the following conditions: 1. All rental trucks shall be stored in the southern portion of the rear parking lot only. 2. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution.
