R-2009- l5 elf A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE NOVEMBER 3, 2009 GENERAL ELECTION FOR CITY COMMISSION DISTRICT 2 AND THE PROSPECT FIELD ROAD ANNEXATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FORAN EFFECTIVE DATE. WHEREAS, a General Election was held on November 3, 2009, wherein the electorate of the City of Tamarac elected one candidate for the Office of Commission Representative from District 2; and WHEREAS, at the end of qualifying on September 8, 2009 the commission representative from District 4 had no opponent, therefore, Harry Dressler was deemed elected to serve as the Commission representative for District 4; and and WHEREAS, a mail ballot election was held for the Prospect Field Road Annexation; WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting, absentee ballots, and mail ballots and has certified such results to the City Clerk of the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Commission for a formal Certification and Declaration of the results; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results Temp. Reso. #11730 November 4, 2009 Page 2 of 3 of the November 3, 2009 General Election for City Commission District 2 and for the Prospect Field Road Annexation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the following are the certified results of the votes received by candidates seeking the Office of Commission Representative from District 2 at the General Election held November 3, 2009: Patricia Atkins -Grad 659 Patti Lynn 425 SECTION 3: That Patricia Atkins -Grad, having received the highest number of votes cast is therefore declared to have been elected as Commission Representative, District 2, of the City of Tamarac for a term of five years. SECTION 4: That Harry Dressler, having run unopposed for Commission Representative for District 4 is deemed to be elected the Commission Representative for District 4 of the City of Tamarac for a term of five years. SECTION 5: That the vote on the Prospect Field Road Annexation was five votes for annexation into Tamarac and five votes against annexation into Tamarac; not being approved by a majority the annexation into Tamarac failed. SECTION 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is Temp. Reso. #11730 November 4, 2009 Page 3 of 3 held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 8: This Resolution shall become effective immediately upon its passage and adoption. THIS SPACE IS INTENTIONALLY LEFT BLANK.
