A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, GRANTING
A TIME EXTENSION OF TWELVE (12) MONTHS
FOR FINAL SITE PLAN APPROVAL, FOR THE
SABAL PALM PROJECT REQUESTED BY
SHAWN CHAIT, DESIGNATED AGENT FOR THE
PROPERTY OWNER, PRESTIGE HOMES OF
TAMARAC INC., (CASE NO. 12-SP-09);
PROVIDING FOR CONDITIONS OF APPROVAL;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Chapter 10 of the City of Tamarac Code of Ordinances provides that
the City Commission may grant time extensions on Site Plan approvals; and
WHEREAS, Shawn Chait, Designated Agent for the property owner, Prestige
Homes of Tamarac Florida Inc., has requested to have the Site Plan extended for twelve
(12) months (hereto attached as Exhibit "1", incorporated herein and made a specific part
thereof) ; and
WHEREAS, the City Commission of the City of Tamarac, Florida, approved a Site
Plan for the Sabal Palm project on April 25, 2007 via Resolution No. R-2007-57 (attached
hereto as Exhibit "2", Temporary Resolution No. 11169); and
WHEREAS, the City Commission of the City of Tamarac, Florida approved a Site
Plan Extension for the Sabal Palm project on May 14, 2008 via Resolution No. R-2008-68
(attached hereto as Exhibit "3", Temporary Resolution No. 11398)
WHEREAS, the Director of Community Development recommends approval of the
twelve (12) months Site Plan Extension from the date of City Commission action regarding

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to grant a time
extension of twelve (12) months for final Site Plan approval for the extension for Sabal
Palm from the date of City Commission action regarding this request.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the application for a twelve (12) month extension for the
Sabal Palm final Site Plan approval, requested by Shawn Chait, Designated Agent for the
property owner, Prestige Homes of Tamarac, Inc., is HEREBY APPROVED subject to the
following conditions:
A. Construction is to be in complete compliance with the plans and
specifications submitted by the developer to the City of Tamarac as
described in the Development Review Status Sheet (attached hereto
as Exhibit "4", Temp Reso No. 11169 of Resolution No. R-2007-57)
and approved final engineering drawings.

B. Commencement of construction shall be no later than twelve (12)
months from November 10, 2010 for the Sabal Palm Site Plan. If the
development does not commence construction within twelve (12)
months, this approval is null and void unless an extension has been
granted in accordance with applicable regulations.
C. The revised development order is assignable, but an assignment
does not discharge any assignee from strict compliance with the order
unless the City Commission consents to modify any of the original
requirements.
D. Additional conditions established in order to issue the revised
development order are set forth as follows:
That if, in the future, there were more stringent requirements
for approval of a Site Plan, that Sabal Palm would modify their
Site Plan to accommodate those new regulations.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its
adoption.

Regarding: Saba[ Palm Justification Letter
Dear Deborah:
The applicant is requesting a Site Plan Extension, proposing to develop
low density (i.e., single family and townhouse) residential uses that are
compatible with the adjacent residential communities. In addition, the
site design of the proposed development will include water bodies and
other appropriate landscape buffers between the new development and
existing contiguous uses in the area. The developer will also mitigate
the impacts of the proposed development on public services and
facilities through the payment of applicable impact fees; the dedication
of land to the City of Tamarac for recreational and open space
purposes, and the mitigation of the proposed development on public
schools in accordance with Broward County School Board Policy No.
1161. The location of this residential development is near.mass transit
routes and also conveniently located near transportation facilities.

WHEREAS, the City Commission has examined the application, the staff and
Planning Board recommendations, and the Development Review Status Sheet dated
April 25, 2007 (attached hereto as Exhibit "I"); and
WHEREAS, the Director of Community Development recommends approval; and
WHEREAS, the Planning Board recommended approval on April 18, 2007; and
WHEREAS, the City Commission reviewed this Revised Development Order and
accompanying documents at a public meeting; and
WHEREAS, the City Commission has determined that the application is in
compliance with all elements of the Comprehensive Plan, or will be in compliance with all
elements of the Comprehensive Plan prior to the issuance of a Certificate of Occupancy for
the development; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to issue Revised
Development Order No. 337.1 and grant New Development Site Plan approval for the
Sabal Palm Project to allow the construction of a total of four -hundred ninety-six (496)
dwelling units consisting of two -hundred eight (208), three (3), four (4),and five (5) bedroom
single-family dwelling units, and two -hundred eighty-eight (288) residential townhomes
consisting of two -hundred fourteen (214), two (2) bedroom units and seventy-four (74),
three (3) bedroom units with associated driveways, guest parking, landscaping, and
infrastructure improvements, located between Florida's Turnpike and Rock Island Road
on
the north and south side of Commercial Boulevard; and

D. Broward County Impact Fees must be paid prior to issuance of a Building
Permit.
E. Local Traffic Impact Fees in the amount of $87,664.00 are due per Section
10-290(c) of the City's Land Development Code.
F. Streetscape Improvement Fees in the amount of $99,200.00 are due per
Section 10-313(b) of the City's Land Development Code.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repeaied to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
