A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE AN APPLICATION BY THE BROWARD SHERIFF'S OFFICE FOR THE RELEASE OF LAW ENFORCEMENT TRUST FUNDS IN THE AMOUNT OF $11,575 TO PROVIDE FUNDING FOR ON -SITE CLINICS FOR TAMARAC'S YOUTH SPORTS COACHES AND PARENTS, FACILITATED BY STAFF OF THE TAMARAC PARKS AND RECREATION DEPARTMENT AND STRUCTURED IN ACCORDANCE WITH THE NATIONAL ALLIANCE FOR YOUTH SPORTS STANDARDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac currently contracts for police services with the Broward Sheriffs Office; and WHEREAS, the City Commission of the City of Tamarac approved a five (5) year Agreement with the Broward Sheriffs Office through the passage and adoption of Resolution No. R-2005-121, a copy of which is available in the City Clerk's Office; and WHEREAS, said Agreement with the Broward Sheriffs Office remains in place until terminated; and WHEREAS, youth sports leagues have been effective at reducing juvenile crime and preventing drug use among children; and WHEREAS, a successful youth sports league program is one which is designed to ensure the emotional, physical, social and education well-being of its participants and provides a safe, secure environment for the children; and Temp. Reso #11716—10/20/09 Rev. 1 — 11 /6/09 Page 2 WHEREAS, the City of Tamarac is desirous of providing on -site clinics for the coaches and parents of Tamarac's youth sport leagues to instruct them in methods of how to ensure the safety and well-being of children in youths sports, as well as, adult accountability for their own behavior; and WHEREAS, said clinics will be structured in accordance with the National Alliance for Youth Sports (NAYS) Standards; and WHEREAS, NAYS is America's leading advocate providing a safe, positive and fun youth sport experience with the organization continually taking a leadership role to assimilate and share best practices for youth sports; and WHEREAS, as leaders, NAYS has developed the National Standards for Youth Sports which have served as the blueprint for how thousands of recreation professionals have conducted youth sports programs to provide a positive experience; and WHEREAS, the purpose of the NAYS Standards is to provide a framework by which youth sports programs are designed and executed; and WHEREAS, the Tamarac Parks and Recreation Department has reinstated the Tamarac Chapter of NAYS and through this chapter will conduct on -site clinics for the youth sports league coaches and parents to assist in establishing and maintaining a safe and positive youth sports experience for the children and volunteers participating in youth sports in the Tamarac community; and 1 Temp. Reso #11716 — 10/20/09 Rev. 1 —11 /6/09 Page 3 WHEREAS, the Broward Sheriffs Office wishes to fund the on -site clinics for the youth sports league coaches and parents at a cost of $20.00 per person for coaches and $5.00 per family for the parents training, for a total cost of $11,575 (385 volunteer coaches; 775 parents); and WHEREAS, Article XII "Fines Forfeitures, Payment", Section 12.3 of the BSO Agreement effective October 1, 2004, provides that any currency seized within the City, through active participation of the Tamarac District's personnel, pursuant to said Agreement and Chapter 932 of Florida Statutes, and subsequently forfeited to the Tamarac District, shall be deposited into the City's Law Enforcement Trust Fund established by the City in an amount which equals the Tamarac District's share; and WHEREAS, said funds shall be and shall always remain in the ownership of the City and may be earmarked for the Tamarac District's use within the confines of the City; and WHEREAS, Section 12.4 of the Agreement with BSO provides that upon concurrence of the District Chief and the City Manager, the Tamarac District may apply to the City for the use of such funds within the boundaries of the City, if such application is in compliance with Florida Statutes; and WHEREAS, on July 9, 2009, the Parks and Recreation Department of the City of Tamarac requested funding for the National Alliance for Youth Sports Clinics for youth sport leagues coaches and parents, a copy of said memorandum attached hereto as Exhibit "A"; and 1 Temp. Reso #11716—10/20/09 Rev. 1 —11 /6/09 Page 4 WHEREAS, in accordance with the requirements of Section 12.4 of the Agreement, the request shown as Exhibit "A" has been determined to be in legal compliance with Florida Statute 932.7055(4) by a BSO legal advisor and is accompanied by a written certification to that effect; and WHEREAS, the City Manager, the BSO Chief of the Tamarac District, the Director of Parks and Recreation, and the Director of Financial Services recommend acceptance of an application by BSO to allow for the release of $11,575 for the National Alliance for Youth Sports Clinics for youth sport leagues coaches and parents; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve the application by BSO to allow for the release of $11,575 for the National Alliance for Youth Sports Clinics for youth sport leagues coaches and parents; and WHEREAS, the City Commission of the City of Tamarac, pursuant to Section 166.241, Florida Statutes, desires to budget and appropriate an amount not to exceed Eleven thousand five hundred seventy five dollars ($11,575) for the LETF fund. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. 1 Temp. Reso #11716 — 10/20/09 Rev. 1 — 11 /6/09 Page 5 SECTION 2: That the appropriate City officials are hereby authorized and directed to approve the application by BSO, as per Exhibit "A", to allow for the release of $11,575 of Law Enforcement Trust Funds for the National Alliance for Youth Sports Clinics for youth sport leagues coaches and parents within the Tamarac community. SECTION 3: It is hereby found and determined that the proposed funds pursuant to Section 166.241, Florida Statutes, the City Commission hereby budgets and appropriates an amount not to exceed Eleven thousand five hundred seventy five dollars ($11,575) from the LETF fund. SECTION 4: Furthermore, the appropriate City Officials are hereby authorized to execute a payment from the Law Enforcement Trust Fund, with funds being transferred to the appropriate Parks and Recreation Department account, for payment of the National Alliance for Youth Sports Clinics for youth sport leagues coaches and parents within the Tamarac community. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 0 Temp. FROM: Linda Probert, Ass stant Director RE: National Alliance for Youth of Parks and Recreation Sports Clinics for youth sport leagues coachesiparents Recommendation: I recommend consideration by the Broward Sheriffs Office to provide funding for the provision of clinics for Tamarac's youth sports coaches and parents, facilitated by staff of the Tamarac Parks and Recreation Department. Issue: The Parks and Recreation Department intends to provide onsite clinics for the coaches and parents of our youth sports leagues. The clinics will be structured in accordance with the National Alliance for Youth Sports Standards. The department is requesting funding assistance for the provision of the clinics. Backaround: The National Alliance for Youth Sports (NAYS) is America's leading advocate for providing a safe, positive and fun youth sports experience. The organization has continually taken a leadership role to assimilate and share best practices for youth sports_ As leaders they have developed the National Standards for Youth Sports which have served as the blueprint for how thousands of recreation professionals have conducted youth sports programs in an effort to provide a positive experience. The purpose of the Standards is to provide a framework by which youth sports programs are designed and executed. Based on recent events that have taken place within our sports leagues, the Tamarac Parks and Recreation Department has reinstated the Tamarac Chapter of NAYS. Through this Chapter we will conduct onsite interactive clinics for our youth sports league coaches and parents. The clinics will assist us in establishing and maintaining a safe and positive youth sports experience for the children and volunteers participating in youth sports in our community. It will be required that all coaches and a minimum of one parent from each household attend the training. NAYS Onsite Clinics July 9, 2009 Page 2 The Parks and Recreation Department staff will serve as the Clinicians and will facilitate the clinics. The NAYS standards, positive coaching and/or parent behavior skills and the code of ethics is provided to clinic attendees by instructors via DVD and through written correspondence. All coaches are required to complete a test at the end of the clinic and sign the coaches' code of ethics. All parents are required to complete the clinic and sign the parents' code of ethics. The cost to provide the clinics is $20.00 per person for coaches and $5,00 per family for the Parents training. The $20.00 annual fee for coaches includes: The interactive clinic, quarterly Youth sports journal, certificate of completion, membership card, $1,000.000 excess general liability insurance (while acting in the capacity of an administrator) and a subscription to Sporting Kid Magazine. The Parents Association for Youth Sports (PAYS) annual fee includes: the clinic, PAYS handbook, PAYS parent card, and one complimentary issue of Sporting Kid Magazine. Currently we offer the following youth sports in Tamarac: girl's softball, tackle football, flag football, baseball, basketball, and soccer.
