R-2009- / 7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A PARKING WAIVER OF THIRTY- SEVEN (37) PARKING SPACES TO REDUCE THE REQUIRED NUMBER OF PARKING SPACES FROM SIX HUNDRED AND FIFTY- THREE (653) TO SIX HUNDRED AND SIXTEEN (616) PARKING SPACES, FOR THE PROPERTY LOCATED AT 10000-10098 W. MCNAB ROAD; (CASE NO. 3-Z-08); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 24 of the City of Tamarac Code of Ordinances provides that the City Commission may grant a limited waiver of the off street parking and loading requirements whenever a hardship would exist by adhering to strict application thereof, and further provides that the waiver would not be detrimental to public safety, health, and welfare of the citizens of the City; and WHEREAS, Lisseth Amil, Designated Agent for the property owner, Tamarac Showplace, LLC., is seeking approval of a Parking Waiver of (37) parking spaces to reduce the required number of parking spaces from six hundred and fifty-three (653) to six hundred and sixteen (616) parking spaces, for the property located at 10000-10098 W. McNab Road. WHEREAS, the application will also allow for modifications to the parking lot layout including an adjustment to the angled parking and traffic circulation; and WHEREAS, a petition for a Minor Revised Site Plan for said modifications was reviewed by the Development Review Committee at its December 18, 2008 meeting and unanimously approved; and Temp Reso #11548 January 20, 2009 Page 2 WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the Planning Board held a public hearing and recommended approval on January 7, 2009; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the Parking Waiver as requested by the applicant Lisseth Amil, Designated Agent for the property owner Tamarac Showplace LLC., of thirty-seven (37) parking spaces to reduce the required number of parking spaces from six hundred and fifty-three (653) to six hundred and sixteen (616) parking spaces, for the property located at 10000-10098 W. McNab 010 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the application of the Parking Waiver for the Tamarac Marketplace Project of thirty-seven (37) parking spaces to reduce the required number of parking spaces from six hundred and fifty-three (653) to six hundred and sixteen (616) parking spaces, at 10000-10098 W. McNab Road; is HEREBY APPROVED subject to the following conditions: Temp Reso #11548 January 20, 2009 Page 3 1 1 A. All parking islands that are directly affected by these modifications will be irrigated planted with a shade or palm tree and sodded. B. A total of twenty-two (22) Cabbage Palm trees and seventeen (17) Mahogany trees will be installed in association with this project. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: adoption.
