HomeMy WebLinkAboutCity of Tamarac Resolution R-2009-174Temp Reso#11711 Page 1 November 19, 2009 CITY OF TAMARAC, FLORIDA RESOLUTION NO R-2009- %-7Ll A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE CONSOLIDATED ANNUAL PERFORMANCE EVALUATION REPORT (CAPER FY2008-2009) FOR THE U.S. DEPARTMENT OF HOUSING & URBAN DEVELOPMENT (HUD)'S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAMS FOR HUD'S FISCAL YEAR 2008-2009; CASE NO.31-MI-09; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, as of October 1, 2008, the City of Tamarac has received funding from the U.S. Department of Housing and Urban Development (HUD) for HUD's Fiscal Year (FY2008-2009) in the amount of $418,811.00 for its Community Development Block Grant (CDBG) Program; and WHEREAS, at the conclusion of each funded year, the City of Tamarac must prepare a Consolidated Annual Performance Evaluation Report (CAPER), which details the expenditures for its approved projects and programs undertaken during that fiscal year; and WHEREAS, the approved CAPER FY 2008-2009 document will be submitted to HUD for approval by December 15, 2009; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in Temp Reso#11711 Page 2 November 19, 2009 the best interests of the citizens and residents of the City of Tamarac to approve the Consolidated Annual Performance Evaluation Report (CAPER FY2008-2009) for submittal to the U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA. SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the City Commission adopt the Consolidated Annual Performance Evaluation Report (CAPER FY 2008-2009) (attached hereto as Exhibit 1 ") to be submitted to the U.S. Department of Housing and Urban Development (HUD) consistent with Community Development Block Grant (CDBG) Program requirements. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 1 1 SECTION 5: passage and adoption. This report assesses the City's performance for fiscal year 2008-2009 relative to the expenditure of funds provided by the Department of Housing and Urban Development (HUD), converge the Community Development Block Grant (CDBG) Program. The City of Tamarac will hold a Public Hearing on Wednesday, December 9, 2009, 7:00 p.m. at City Hall, 7525 N.W. 88t" Avenue, Tamarac, FL 33321. The City will submit this report to the local HUD office on or about December 15t", 2009. The City of Tamarac complies with the provision of the American with Disabilities Act.
