R-2009- / 7- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING THE RESULTS OF THE DECEMBER 18, 2009 SPECIAL ELECTION FOR MAYOR -AT -LARGE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Special Election was held on December 18, 2009, wherein the electorate of the City of Tamarac elected one candidate for the Office of Mayor -At -Large; and WHEREAS, the Broward County Canvassing Board has canvassed the results of the machine voting and absentee ballots and has certified such results to the City Clerk of the City of Tamarac; and WHEREAS, the City Clerk has reviewed the certification from the Broward County Canvassing Board and has presented their findings to the City Commission for a formal Certification and Declaration of the results; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to declare the results of the December 18, 2009 Special Election for Mayor -At -Large. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE -CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the following are the certified results of the votes received by candidates seeking the Office Mayor -At -Large at the Special Election held December 18, 2009: Beth Flansbaum-Talabisco 1,819 Gunther Livingston 260 Temp. Reso. #11736 December 21, 2009 Page 2 of 2 SECTION 3: That Beth Flansbaum-Talabisco, having received the highest number of votes cast is therefore declared to have been elected as Mayor -At -Large, of the City of Tamarac for a term of five years. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 6: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 22Id day of December, 2009.
