A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, OPPOSING THE
COMMITTEE SUBSTITUTE FOR FLORIDA SENATE BILL
360 — AN ACT RELATED TO GROWTH MANAGEMENT,
AND OTHER LEGISLATIVE PROPOSALS THAT
WEAKEN GROWTH MANAGEMENT; DIRECTING THE
CITY CLERK TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE FLORIDA LEAGUE OF CITIES,
THE BROWARD LEAGUE OF CITIES, THE GOVERNOR,
THE PRESIDENT OF THE FLORIDA SENATE, THE
SPEAKER OF THE FLORIDA HOUSE OF
REPRESENTATIVES, AND THE MEMBERS OF THE
BROWARD LEGISLATIVE DELEGATION; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac, Florida supports the
broad economic development goals set forth by Senate President Jeff Atwater in his
address to the Senate Select Committee on Florida's Economy at its initial meeting on
December 10, 2008; and
WHEREAS, the City Commission of the City of Tamarac, Florida is generally
supportive of the concepts in Senate Bill 360 ("CS/SB360") which encourage more
compact urban infill development and redevelopment, and economic development; and
WHEREAS, notwithstanding its support of some of the concepts proposed
therein, the City Commission of the City of Tamarac, Florida would be profoundly and
adversely affected by CS/SB 360 as currently proposed; and
WHEREAS, the City Commission of the City of Tamarac, Florida is concemed
with the significant adverse impact this legislation, as currently proposed, will have on
economic development and quality of life in South Florida and throughout the State; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems that the
Developments of Regional Impact program is an important and valuable tool which is

needed to assess and mitigate inter jurisdictional impacts of large-scale development
while supporting economic development and an enhanced quality of life; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the
best interests of the citizens and residents of the City and throughout the State of Florida
to oppose CS/SB 360.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
Section 1. The foregoing "WHEREAS" clauses are confirmed and ratified as
being true and correct and are hereby incorporated herein.
Section 2. The City Commission of the City of Tamarac, Florida hereby
opposes CS/SB 360 and further requests that the Florida Legislature consider the
detrimental consequences of any legislation that would:
• Exacerbate suburban sprawl
• Add to vehicle miles traveled and climate change
Add to cities' and counties' backlog of infrastructure needs
Eliminate impact fees that pay for real impacts to communities
• Affect our natural resources
• Remove or alter school concurrency
• Create unfunded mandates
Emasculate the role of the Department of Community Affairs
Section 3. The City Commission of the City of Tamarac, Florida requests
appropriate amendments in support of economic development and responsible growth
management to enhance Florida's economy while ensuring protection of Florida's
resources of regional significance and communities.
Section 4. The City Commission of the City of Tamarac, Florida requests that
the legislation include sunset provisions that will allow for further review and evaluation.
Section 5. The City Clerk is hereby directed to provide a certified copy of this
Resolution to the Florida League of Cities, the Broward League of Cities, Governor

Charlie Christ, President of the Florida Senate, the Speaker of the Florida House of
Representatives, and the members of the Broward Legislative Delegation.
Section B. All resolutions or parts of resolutions in conflict herewith be, and the
same are hereby repealed to the extent of such conflict.
Section 7. If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 8. This Resolution shall become effective immediately upon its
passage and adoption.
PASSED AND ADOPTED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THIS DAY OF , 2009.
