RESOLUTION NO. R-2009 - 3.7
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO AUTHORIZE THE
PURCHASE AND INSTALLATION OF VIRGINIA GRAEME
BAKER POOL AND SPA SAFETY ACT APPROVED DRAIN
COVERS FOR THE CAPORELLA AQUATIC CENTER IN AN
AMOUNT NOT TO EXCEED $40,000.00 FROM THE
APPROPRIATE ACCOUNTS; AUTHORIZING BUDGET
AMENDMENTS AS NEEDED FOR PROPER ACCOUNTING
PURPOSES; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Tamarac desires to protect its
residents and citizens from all life safety issues within the City; and
WHEREAS, in December, 2007, the Virginia Graeme Baker Pool and Spa Safety
Act was signed into law requiring safety improvements at all public pools and spas to
prevent drowning and entrapment; and
WHEREAS, the City has contracted the services of DeRose Design Consultants,
Inc., to determine the City's compliance to the Virginia Graeme Baker Pool and Spa Safety
Act and design a solution that would provide for Tamarac's compliance to the new
legislation, a copy of this report is attached hereto as "Exhibit 1 ", all exhibits attached
hereto are incorporated herein and made a specific part of this resolution; and
WHEREAS, the manufacturing and installation of the necessary drain covers to
comply with the Virginia Graeme Baker Pool and Spa Safety Act will require an expenditure
in an amount not to exceed $40,000.00; and

WHEREAS, the Public Works Director, Director of Park and Recreation, and the
Purchasing and Contracts Manager recommend that the appropriate City Officials
authorize an expenditure in the amount not to exceed $40,000.00 to comply with the
Virginia Graeme Baker Pool and Spa Safety Act; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize an
expenditure in the amount not to exceed $40,000.00 to comply with the Virginia Graeme
Baker Pool and Spa Safety Act.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The appropriate City officials hereby authorize an expenditure in
the amount not to exceed $40,000.00 to comply with the Virginia Graeme Baker Pool and
Spa Safety Act.
SECTION 3: Funding in an amount not to exceed $40,000.00 has been
approved.
SECTION 4: All budget amendments for proper accounting purposes are
hereby authorized.
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 7: This Resolution shall become effective immediately upon its
passage and adoption.

Dear Mr. Moore,
Below please find our narrative outlining existing conditions as verified by field
measurements and observations as well as requirements for compliance of the "Federal Pool
& Spa Safety Act' as it relates to both pools located within the Caporella Aquatic Complex.
The Federal Pool & Spa Safety Act, aXa. Virginia Graeme Baker Act authored by the
Consumer Product Safety Commission was enacted December 19, 2007 mandating the all
public pools comply with specific requirements by December 19, 2008. The specific
requirements contain such items as replacement of the main drain grate/cover meeting
ASME/ANSI Standard All 2.19.8 - 2007, installation of a second layer of protection such as
gravity fed drainage system, suction limiting vent systems or safety vacuum release
systems. The ASME/ANSI Standard addresses testing and performance requirements
including Body Entrapment, Hair Entrapment, Finger Entrapment and U.V. Exposure. The
Standard also requires that the grate/covers accommodate the maximum capable flow of all
pumps. This requirement differs from former codes and industry standards, (pre-2007) in
that grate/covers were required only to accommodate the design flow of all pumps. Current
& pending Florida codes require that the velocity not exceed 1.5 f.p.s. Below illustrates the
change in flow requirements attributed to the Federal Act specifically for each of the two
pools.

As you can see the maximum flow requirements are nearly double the design flow
requirements. Simple math suggests that the grate/covers need to be two times larger than
existing, however the requirement for finger entrapment minimizes the allowable open area
in each grate/cover. In other words, the new grate/covers have less open area square foot to
square foot compared to existing gratelcovers.
The Caporella Aquatic Center complies with the Act regarding the secondary layer of
protection as it utilizes gravity fed collector tanks. The Center must now comply with the
main drain gratelcover requirement.
Concurrently, the State of Florida Department of Health has pending changes to F.A.C. 64E-
9 regarding Public Swimming Pools and Bathing Places requiring all public pools/spas be
removed from direct suction by means of a gravity fed collection system. The Caporella
Aquatic Center complies with the pending code change.
