CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2009-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING A WAIVER OF
BUILDING DEPARTMENT'S PERMIT FEES FOR THE
INSTALLATION OF WATER CONSERVATION RETROFIT
DEVICES, FIXTURES, AND APPURTENANCES AS A PART
OF ANY SOUTH FLORIDA WATER MANAGEMENT
DISTRICT'S WATER SAVINGS INCENTIVE PROGRAM;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY• AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the excessive use of water is a threat to water supply in South Florida's
counties and cities; and
WHEREAS, the installation of water conservation retrofit devices, fixtures, and
appurtenances provides an opportunity to conserve water by reducing the excessive use of
water for indoor and outdoor purposes without changing a person's water use patterns;
and
WHEREAS, the City of Tamarac received a grant from the South Florida Water
Management District's Water Savings Incentive Program and will use a portion of this grant
to supply water conservation devices; including, but not limited to rain shut-off devices,
toilets, low -flow showerheads, spray nozzles, toilet flush valves, and urinals to water
customers; and

WHEREAS, the Water Savings Incentive Program is an annual program providing
water conservation devices, and
WHEREAS, the City of Tamarac shall waive the permit and inspection fees forwater
conservation devices for program participants within the City; and
WHEREAS, the City of Tamarac shall select participants for the program from
single-family homes, multi -family homes, condominiums, and commercial accounts using
potable water; and
WHEREAS, the Directors of Utilities and Building recommend that the City of
Tamarac waive the Building Department's permit fees for participants in the Water Savings
Incentive Program; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to waive permit and
inspection fees for participants in the Water Savings Incentive Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE

CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this resolution.
SECTION 2: The City of Tamarac agrees to waive the Building Department's
permit fees for the installation of water conservation retrofit devices, fixtures, and
appurtenances installed under the South Florida Water Management District's Water
Savings Incentive Program grant.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: The Resolution shall become effective immediately upon its
passage and adoption.
