Reso. 11615 Page 1 of 4 May 11, 2009 CITY OF TAMARAC, FLORIDA RESOLUTION R2009-,( f A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA URGING GOVERNOR CHARLIE CRIST TO VETO SENATE BILL 532, HOUSE BILL 227, SENATE BILL 360, SENATE BILL 1000, AND SENATE BILL 216; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Legislature recently adopted a number of House and Senate bills and transmitted the legislation to Governor Charlie Crist for his review and signature or veto; and WHEREAS, among the bills adopted by the Legislature were Senate Bill 532 ("SB532), House Bill 227 (" HB227" ), Senate Bill 360 ("SB360"), Senate Bill 1000 ("SB1000"), and Senate Bill 216 ("SB216"); and WHEREAS, the City Commission of the City of Tamarac, Florida (the "City") is adamantly opposed to each of the above -referenced bills and strongly urges Governor Charlie Crist to veto the same; and WHEREAS, SB532 will adversely affect the citizens and residents of the City as well as those throughout the State of Florida by, among other things, reducing the maximum annual assessment of non -homestead property to five percent (5%) annually; and WHEREAS, HB227 imposes a hardship on local governments by creating a burden of proof for the imposition of impacts fees which such entities are otherwise empowered to impose pursuant to their Home Rule authority; and Temp. Reso. 11615 Page 2 of 4 May 11, 2009 WHEREAS, on the March 11, 2009 City Commission adopted Resolution No. R- 2009-30, thereby opposing S13360, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference, and the City Commission hereby reaffirms its objections to SB360 as set forth therein; and WHEREAS, SB1000 empowers counties to impose a discretionary fire rescue surtax thereby infringing on municipalities' Home Rule authority and creating an additional burden on municipal fire rescue services; and WHEREAS, SB216 prohibits local governments from expending public funds on political advertisements or electioneering communication which concerns an issue, referendum or amendment which is subject to the vote of the electors; and WHEREAS, the restrictions of SB216 have a chilling impact on first amendment freedoms and are a slippery slope on the infringement of the right of the general public to have their voices heard through their elected officials; and WHEREAS, SB216 further significantly impacts the ability of elected officials to keep their constituents informed about potential issues that the electorate is asked to consider; and WHEREAS, the City Commission has great concerns about the impact that these legislative proposals will have on the citizens and residents of the City and throughout the State; and L 1 1 Temp. Reso. 11615 Page 3 of 4 May 11, 2009 WHEREAS, the City Commission deems it to be in the best interests of the citizens and residents of the City for Governor Crist to veto S13532, 1-113227, SB360, S131000, and 56216. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1. The foregoing "WHEREAS" clauses are confirmed and ratified as being true and correct and are hereby incorporated herein. Section 2. The City Commission of the City of Tamarac hereby urges Governor Charlie Crist to veto S13532, H13227, S13360, S131000, and S13216. Section 3. The City Clerk is hereby directed to provide a certified copy of this Resolution to the Florida League of Cities, the Broward League of Cities, Governor Charlie Crist, President of the Florida Senate, the Speaker of the Florida House of Representatives, and the members of the Broward Legislative Delegation. Section 4. All resolutions or parts of resolutions in conflict herewith be, and the same are hereby repealed to the extent of such conflict. Section 5. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Section 6. This Resolution shall become effective immediately upon its passage and adoption. WHEREAS, the City Commission of the City of Tamarac, Florida supports the broad economic development goals set forth by Senate President Jeff Atwater in his address to the Senate Select Committee on Florida's Economy at its initial meeting on December 10, 2008; and WHEREAS, the City Commission of the City of Tamarac, Florida Is generally supportive of the concepts in Senate Bill 360 ("CS/SB360") which encourage more compact urban infill development and redevelopment, and economic development; and WHEREAS, notwithstanding its support of some of the concepts proposed therein, the City Commission of the City of Tamarac, Florida would be profoundly and adversely affected by CS/SB 360 as currently proposed; and WHEREAS, the City Commission of the City of Tamarac, Florida is concerned with the significant adverse impact this legislation, as currently proposed, will have on economic development and quality of life in South Florida and throughout the State; and WHEREAS, the City Commission of the City of Tamarac, Florida deems that the Developments of Regional Impact program is an important and valuable tool which is Temp. Reso. 11589 Page 2 of 4 January 14, 2009 needed to assess and mitigate inter jurisdictional impacts of large-scale development while supporting economic development and an enhanced quality of life; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interests of the citizens and residents of the City and throughout the State of Florida to oppose CS/SB 360. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1. The foregoing "WHEREAS" clauses are confirmed and ratified as being true and correct and are hereby incorporated herein. Section_2. The City Commission of the City of Tamarac, Florida hereby opposes CS/SB 360 and further requests that the Florida Legislature consider the detrimental consequences of any legislation that would: • Exacerbate suburban sprawl • Add to vehicle miles traveled and climate change Add to cities' and counties' backlog of infrastructure needs Eliminate impact fees that pay for real impacts to communities • Affect our natural resources • Remove or alter school concurrency • Create unfunded mandates • Emasculate the role of the Department of Community Affairs Section 3. The City Commission of the City of Tamarac, Florida requests appropriate amendments in support of economic development and responsible growth management to enhance Florida's economy while ensuring protection of Florida's resources of regional significance and communities. Section 4. The City Commission of the City of Tamarac, Florida requests that the legislation include sunset provisions that will allow for further review and evaluation. Section S. The City Clerk is hereby directed to provide a certified copy of this Resolution to the Florida League of Cities, the Broward League of Cities, Governor I 1 Temp.
