CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2009
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, ACKNOWLEDGING THAT TWO PARTICIPANTS IN
THE CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG")
PROGRAM AND THE STATE HOUSING INITIATIVE PARTNERSHIP
PROGRAM ("SHIP") RECEIVED MORE THAN THE MAXIMUM
ALLOCATION OF FUNDING; ENSURING THAT THE CITY STAFF HAS
TAKEN THE NECESSARY ADMINISTRATIVE ACTION TO AVOID A
RECURRENCE OF THIS ERROR; PROVIDING FOR CONFLICT;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Tamarac, Florida (hereinafter referred to as the "City"),
receives funds from the United States Department of Housing and Urban Development
Community Development Block Grant Program ("CDBG") and the State of Florida's
Housing Partnership Initiative ("SHIP") to assist homeowners with repairs to their
homes; and
WHEREAS, the City's administrative staff evaluates applicants who desire to
receive CDBG and SHIP funds in order to determine who is eligible to receive CDBG and
SHIP funds for home repair assistance; and
WHEREAS, recently, an audit of the City's CDBG and SHIP funds was performed,
and as a result of the audit, it appears that two recipients of CDBG and SHIP funds have
received more than the maximum allowable allocation of funding provided by the CDBG
and SHIP program guidelines; and

WHEREAS, the City Commission acknowledges that a good faith error was made
by certain members of the City's administrative staff in distributing funds for the CDBG and
SHIP programs and assures the State of Florida, and the United States Department of
Housing and Urban Development ("HUD") and the State of Florida that certain policies are
being crafted to ensure that such instances do not occur in the future; and
WHEREAS, the City Commission deems it to be in the best interests of the citizens
and residents of the City to acknowledge the CDBG and SHIP program funding errors,
and inform the State of Florida and HUD that measures are being taken to avoid a
recurrence of this situation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
Section 1. The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
Section 2. The City Commission of the City of Tamarac, Florida hereby
acknowledges that as a result of a good faith oversight on the part of certain members of
the City's administrative staff that applicants for the City's CDBG and SHIP programs, Ms.
McKenna and Irene Thomson, received more than the maximum allowable allocation of
funding provided by the CDBG and SHIP programs pursuant to the City's Local Housing
Assistance Plan. The City Commission further assures the State of Florida and HUD that
certain policy initiatives are being crafted to avoid any future recurrence of this error.

Section 3. All resolutions or parts of resolutions in conflict herewith be, and the
same are hereby repealed to the extent of such conflict.
Section 4. If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 5. This Resolution shall become effective immediately upon its
passage and adoption.
