RESOLUTION NO. R-2009- 2 J
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING A REFUND OF $2,000.00
SUBMITTED BY MANUEL SYNALOVSKI OF
CUBELLIS, INC. DESIGNATED AGENT FOR
THE PROPERTY OWNER, TAMARAC JEWISH
CENTER INC., FOR A SPECIAL EXCEPTION
APPLICATION FEE, COLLECTED FOR THE
TEMPLE BETH TORAH PROJECT (CASE NO.
11-MI-09); PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on January 27, 2009 Manuel Synalovski of Cubellis, Inc., Designated
Agent for the property owner Tamarac Jewish Center Inc., submitted a Special Exception
application to the Community Development Department with a check in the amount of
$2,000.00 for a Special Exception application for the Temple Beth Torah project; and
WHEREAS, after the submittal of the Special Exception application, the Community
Development Department staff in conjunction with the City Attorney's office, determined
that this application was not needed for the project; and
WHEREAS, the Community Development Department staff has determined that the
Special Exception application fee of $2,000.00 submitted by Manuel Synalvoski of Cubellis
Inc., Designated Agent for the property owner Tamarac Jewish Center, Inc., should be
refunded since no staff time, research or resources were used to process the application
(attached hereto as Exhibit "1" and incorporated herein and made a specific part therof);
and

WHEREAS, the Director of Community Development recommends approval of the
application fee refund; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize a refund
in the amount of $2,000.00 submitted by Manuel Synalovski of Cubellis, Inc., Designated
Agent for the property owner Tamarac Jewish Center, Inc. for the Special Exception
application fee, collected for the Temple Beth Torah project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution;
all exhibits attached hereto are incorporated herein and made a specific part of this
Resolution.
SECTION 2: That the City Commission hereby authorizes the appropriate
City Officials to refund the Special Exception application fee for the Temple Beth Torah
project in the amount of $2,000.00 made payable to Temple Beth Torah Construction
Account, 9101 NW 57t" Street, Tamarac, Florida 33351-4311.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in
part or in application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
adoption.
