R-2009 - 4 / A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO FILE AN APPLICATION THROUGH THE BROWARD SHERIFF'S OFFICE ACCEPTING FY2009 GRANT FUNDING IN THE AMOUNT OF $20,410 FROM THE U.S. DEPARTMENT OF JUSTICE THROUGH THE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM WITH NO MATCH REQUIRED BY THE CITY TO HELP OFFSET COSTS OF LAW ENFORCEMENT SERVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desires to enhance its crime prevention and law enforcement programs; and WHEREAS, the U.S. Department of Justice, Bureau of Justice Assistance provides grants for projects that will reduce crime and improve public safety; and WHEREAS, the U.S. Department of Justice, Bureau of Justice Assistance has determined the City's eligibility for 2009 Justice Assistance Grant (JAG) funds in the amount of $20,410 with no match required specifying that one party serve as the lead agency for Broward County for purposes of application submission and grant administration; and WHEREAS, the City of Tamarac agrees to have the Broward Sheriffs Office serve as the lead agency for said purposes; and WHEREAS, the City recommends implementation of the Broward Sheriffs Office District VII proposal, attached hereto as Exhibit 1, for utilization of the Justice Assistance Grant funding to improve public safety and enhance law enforcement in Tamarac; and Temp. Reso. #11642 Page 2 June 12, 2009 WHEREAS, upon award any and all funds acquired through this grant will be expended to enhance crime prevention and law enforcement programs for Tamarac residents through the Broward Sheriffs Office; and WHEREAS, the City of Tamarac posted meeting notices and a Public Hearing regarding the intended use of the Justice Assistance Grant Funds was held pursuant to the grant requirements; and WHEREAS, the Assistant City Manager and the Broward Sheriffs Office Tamarac District Chief recommend applying for the Justice Assistance Grant; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to file an application through the Broward Sheriffs Office accepting FY2009 grant funding in the amount of $20,410 from the U.S. Department of Justice through the Justice Assistance Grant (JAG) program for the purposes outlined in Exhibit 1 to enhance crime prevention and law enforcement in Tamarac. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1; The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of this resolution. SECTION 2: The City Commission of the City of Tamarac, Florida hereby authorizes the appropriate City Officials to file an application through the Broward Sheriff s Office accepting FY2009 grant funding in the amount of $20,410 from the U.S. Department of 1 C Temp. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, In part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Marc Duguay Tamarac District SUBJECT: Edward Byrne Memorial Justice Assistance Grant Program FY2009 Local Solicitation This memorandum is in reference to the Edward Byrne Memorial Justice Assistance Grant Program FY2009 Local Solicitation. The award for the aforementioned program is based on population and Part 1 violent crime statistics. The total amount awarded the City of Tamarac for this grant is $20,410.00. As the Chief of BSO-Tamarac, I am recommending the following projects to be funded through this grant: Administrative Fees: $1,020.00 The lead agency administering a grant is entitled to use up to ten percent of the award to administer the grant. In the .past BSO has never chosen to use any of the awards for the administration of these similar grant programs. With the budget cutbacks and a sizeable increase in the number of grants they now administer, the BSO Office of Grants Management now asks for five (5%) percent of the 2009 award to administer this program. Supplemental Police Protection $15,392.00 This allocation provides for unbudgeted Special Detail Deputies to be employed by the City of Tamarac using the existing BSO Special Detail Office Permit Number. These funds are to be used to employ SPECIAL DETAIL DEPums, at the agency established detail rate of $37.00 per hour. SPECIAL DETAIL DEPUTIES will be used for a myriad of tasks to include; special operations or patrol deployments, truancy intervention, gang enforcement operations, pro -active drug enforcement, and Page 1 or2 violent crime reduction operations, and for providing safety and security to various Tamarac Parks, buildings and/or events. Funding Breakdown: Special Detail Deputy $37.00 per hour for 416 hours (8 hours per week x 52 weeks) = $15,392.00 Police Patrol Bicycles: $3,998.00 The Tamarac District would purchase 4 Police Patrol Bicycles for use by Tamarac District personnel. These Police Patrol Bicycles would greatly assist deputies in conducting pro -active patrols of Tamarac City parks, recreational facilities and commercial and retail properties. In addition to being a great crime -fighting tool, these bicycles would allow for enhanced visibility of Patrol Deputies throughout the community and are in line with the City of Tamarac's Green initiatives. Should you have any questions in reference to the above mentioned matter, please do not hesitate to contact me. cc: Diane Philips, Assistant City Manager Page 2 of 2 2009 - 2012 BYRNE JUSTICE ASSISTANCE LOCAL SOLICITATION GRANT PROGRAM MEMORANDUM OF UNDERSTANDING (MOU) This Memorandum of Understanding (MOU) is being executed by the below listed parties: BROWARD COUNTY SHERIFF'S OFFICE CITY OF COCONUT CREEK CITY OF CORAL SPRINGS CITY OF DANIA BEACH TOWN OF DAVIE CITY OF DEERFIELD BEACH CITY OF FORT LAUDERDALE CITY OF HALLANDALE BEACH CITY HOLLYWOOD CITY OF LAUDERDALE LAKES CITY OF LAUDERHILL CITY OF MARGATE CITY OF MIRAMAR CITY OF NORTH LAUDERDALE CITY OF OAKLAND PARK CITY OF PEMBROKE PINES CITY OF PLANTATION CITY OF POMPANO BEACH CITY OF SUNRISE CITY OF TAMARAC CITY OF WESTON Nothing in this MOU should be construed as limiting or impeding the basic spirit of cooperation, which exists between the participating agencies, listed above. 1. PURPOSE This MOU establishes the relationship between the parties for participation in the 2009 Byrne Justice Assistance Local Solicitation Grant Program (JALSG). II. PROCEDURES A) The Broward Sheriffs Office (BSO) will be the lead agency and Grant Administrator for the agencies in Broward County, Florida, participating in the JALSG Program. Pursuant to the JALSG Program guidelines, funding from the JALSG Program will be provided to the Broward Sheriffs Office. The Broward Sheriffs Office shall then disperse the funds to the parties in amounts determined by the JALSG Program. For Cities that currently contract with the Broward Sheriffs Office for police services, BSO shall retain the funds for use in the appropriate BSO districts pursuant to the contracts for police services. B) The JALSG allows for the lead agency to take up to 10% of the total award amount ($1,040,450.00) to defray the administrative costs of administering the award. For this grant program, BSO has elected to take 5% of the award amount for each grantee listed herein, for the costs incurred by BSO to administer the grant.. ADMINISTRATIVE Each party shall be responsible for submitting their own application for their individual JALSG Program to the Broward Sheriffs Office. The Broward Sheriffs Office, Grants Management Office, will prepare the single application to include Program Narrative and Budget Narrative, and shall submit the application to the Office of Justice Programs, Bureau of Justice Assistance. IV. DURATION This MOU shall remain in effect upon execution and shall through September 30, 2012 at 11:59 PM and its continuation shall be subject to the availability of necessary funding from the JALSG Program. This MOU may be modified at any time upon written agreement of all involved agencies. The participating agencies may withdraw from this agreement at any time by providing a 30 day written notice of its intent to withdraw to all other participating agencies. V. LIABILTY Each party is entitled to the privileges and protections of sovereign immunity pursuant to Ch. 768.28, Fla. Stat. Pursuant to that section, each party shall be responsible for the negligent acts of their respective employees. Nothing in this MOU shall be construed to create a third -party beneficiary or a waiver of sovereign immunity. VI. GUIDELINES Each party must adhere to requirement standards set forth in the Office of Justice Programs' Financial Guide, as amended and Federal OMB Circular A- 133, as applicable. VII. RECORDS (A) Each Party shall retain sufficient records demonstrating its compliance with the terms of this Agreement for a period of five years from the date of execution of the MOU, and shall allow SHERIFF access to such records upon request. (B) Each Party, its employees or agents, shall allow access to its records concerning this MOU at reasonable times to SHERIFF, its employees, and agents. "Reasonable" shall be construed according to the circumstances but ordinarily shall mean during normal business hours of 8:00 a.m. to 5:00 p.m., local time, on Monday through Friday. "Agents" shall include, but not limited to, auditors retained by SHERIFF. (C) Upon reasonable notice, RECIPIENT shall provide such additional updates or information as may be required by SHERIFF.
