R-2008- •'C�� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DECLARING CERTAIN EQUIPMENT AS SURPLUS AND DIRECTING THAT CERTAIN COMPUTER EQUIPMENT BE DISPOSED OF VIA DONATION TO THE TAMARAC CHAMBER OF COMMERCE AND MILLENNIUM MIDDLE SCHOOL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY ; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac periodically reviews its inventory to identify surplus and obsolete equipment which has reached a sufficient level to warrant disposal; and WHEREAS, certain computer equipment has been determined to be surplus or obsolete; and WHEREAS, the computer equipment may yet be useful for the applications of other entities or individuals; and WHEREAS, all three public schools within the City were approached, Tamarac Elementary School, Challenger Elementary School, and Millennium Middle School, as well as the Touchdowns4Life Charter School, the Tamarac Chamber of Commerce and Neighbors Assisting Neighbors; and WHEREAS, the Tamarac Chamber of Commerce and Millennium Middle School have expressed an interest in the acquisition of these surplus or obsolete computers since their applications can be served by these units; and WHEREAS, pursuant to §6-153 of the Code of Ordinances, the City Commission may by Resolution direct the City Manager to dispose of the surplus supplies by the method or methods deemed to be most advantageous, convenient and economical to the City; and Temp. Reso #11432 July 9, 2008 Page 2 WHEREAS, the City Manager may dispose of surplus stock by utilizing competitive sealed bids, public auction, established markets, sales at posted prices, donation, or trade- in as may be prescribed for the individual situation; and WHEREAS, the City Manager has delegated the responsibility for property disposal to the Director of Information Technology and the Purchasing and Contracts Manager; and WHEREAS, the Director of Information Technology and the Purchasing and Contracts Manager recommend that disposal of these surplus and obsolete computers be accommodated by donation of two (2) computers (including two (2) monitors, two (2) keyboards and two (2) mice) to the Tamarac Chamber of Commerce and those remaining items to Millennium Middle School; and WHEREAS, pursuant to §6-153, a list of said computer equipment available is attached hereto as Exhibit A; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents to approve the donation of surplus and obsolete computer equipment to the Tamarac Chamber of Commerce and Millennium Middle School. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The appropriate City Officials declare that the property in Exhibit "A" consists of surplus and obsolete computer equipment and direct that said computer equipment be disposed of via donation to the Tamarac Chamber of Commerce and 1 1 1 Temp. Reso #11432 July 9, 2008 Page 3 Millennium Middle School. SECTION 3 All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of the Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this day of , 2008.
