RESOLUTION NO. R-2008-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO APPROVE AN
APPLICATION BY THE BROWARD SHERIFF'S OFFICE FOR
THE RELEASE OF LAW ENFORCEMENT TRUST FUNDS IN
THE AMOUNT OF $41,328 TO PROVIDE FOR THE
PURCHASE OF AIRCARDS FOR USE WITHIN THE CITY OF
TAMARAC AS PROVIDED BY ARTICLE XII "FINES,
FORFEITURES; PAYMENT", SECTION 12.4 OF THE
AGREEMENT BETWEEN THE CITY OF TAMARAC AND THE
BROWARD SHERIFF'S OFFICE (BSO) EFFECTIVE
OCTOBER 1, 2004; PROVIDING FOR APPROPRIATED
BUDGET; PROVIDING FOR CONFLICTS; PROVIDNG FOR
SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Tamarac currently contracts for police services with the
Broward Sheriff's Office; and
WHEREAS, the City Commission of the City of Tamarac approved a five (5) year
Agreement with the Broward Sheriffs Office as Resolution R-2005-121, a copy of which is
available in the City Clerk's Office; and
WHEREAS, the City of Tamarac is desirous of maintaining a high level of competent
professional police service; and
WHEREAS, the Broward Sheriffs Office has initiated several new programs to
increase the efficiency of the police service that they provide; and
WHEREAS, one initiative is to bring a state-of-the-art records management system
to the agency as a whole; and

WHEREAS, BSO has installed the Sungard OSSI system, which will allow BSO
deputies' laptops to be able to receive electronic data and critical information while on
patrol, while remaining in their patrol zones, which was not previously available; and
WHEREAS, in order to access this electronic data, it is necessary to maintain
remote internet access in BSO patrol vehicles; and
WHEREAS, current Radio Frequency (RF) Technology does not support this
application; and
WHEREAS, in order to access the internet, it is necessary for BSO to procure
internet aircards, providing for remote internet access in patrol vehicles; and
WHEREAS, internet aircards will also provide access to additional law enforcement
databases including, but not limited to Computer aided dispatch (CAD), NCIC/FCIC data,
DHSMV driver's license databases (both driver's license and photo applications), BSO
booking photos, the BSO Warrant narrative system and the Florida Criminal Justice
Network; and
WHEREAS, BSO currently utilizes contracts with Sprint and A T & T; and
WHEREAS, BSO is requesting aircards totaling $41,328.00 total; and
WHEREAS, the Broward County Sheriff is requesting that the City of Tamarac fund
the initial acquisition of aircards in the amount of $41,328.00; and
WHEREAS, upon the initial acquisition of aircards, BSO will bear all costs to
maintain the aircards; and
WHEREAS, Article XII "Fines Forfeitures; Payment", Section 12.3 of the BSO
Agreement effective October 1, 2004, provides that any currency seized within the City,
through active participation of the Tamarac District's personnel, pursuant to said
Agreement and Chapter 932 of Florida statutes, and subsequently forfeited to the

Tamarac District, shall be deposited into the City's Law Enforcement Trust Fund
established by the City in amount which equals the Tamarac District's share; and
WHEREAS said funds shall be and shall always remain in the ownership of the City
and may be earmarked for the Tamarac District's use within the confines of the City; and
WHEREAS Section 12.4 of the Agreement with BSO provides that upon
concurrence of the District Chief and the City Manager, the Tamarac District may apply to
the City for the use of such funds within the boundaries of the City, if such application is in
compliance with Florida Statutes; and
WHEREAS, on September 11, 2008, the Broward Sheriffs Office formally presented
an application in the amount of $41,328.00 for the purchase of wireless data aircards for
laptops, included herein as Exhibit "A"; and
WHEREAS, in accordance with the requirements of Section 12.4 of the Agreement,
the request shown as Exhibit "A" has been determined to be legal compliance with Florida
Statute 932.7055(4) by a BSO legal advisor and is accompanied by a written certification to
that effect; and
WHEREAS, the City Manager, the BSO Chief of the Tamarac District, the Director of
Information Technology, and the Director of Financial Services recommend the acceptance
of an application by BSO to allow for the release of $41,328.00 for internet wireless
aircards to be utilized by BSO personnel strictly within the confines of the City of Tamarac;

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve the
application by BSO to allow for the release of $41,328.00 for internet wireless aircards to
be utilized by BSO personnel strictly within the confines of the City of Tamarac.

WHEREAS, the City Commission of the City of Tamarac, pursuant to Section 166.241,
Florida Statutes, desires to budget and appropriate an amount not to exceed Forty One
Thousand and 328/100 ($41,328.00) Dollars from the LETF fund.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
SECTION 2: The appropriate City officials are hereby authorized and
directed to approve the application by BSO, included herein as Exhibit "A", to allow for the
release of $41,328.00 of Law Enforcement Trust Funds for internet wireless aircards to be
utilized by BSO personnel strictly within the confines of the City of Tamarac.
SECTION 3: It is hereby found and determined that the proposed funds pursuant
to Section 166.241, Florida Statutes, the City Commission hereby budgets and
appropriates an amount not to exceed Forty One Thousand and 328/100 ($41,328.00)
Dollars from the LETF fund.
SECTION 4: Furthermore, the appropriate City Officials are hereby
authorized to execute a payment from the Law Enforcement Trust Fund, payable to BSO,
in order for BSO to enter an order for internet wireless aircards.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 6: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of the
Resolution.
SECTION 7: This Resolution shall become effective immediately upon its
passage and adoption.

RE: Request for Appropriation — Law Enforcement Trust Fund (LETF),
Wireless Data Air Cards
Dear Mayor Talabisco:
Request is hereby made for the following -described appropriation from the Law
Enforcement Trust Fund (LETF).

The Broward Sheriff's Office supports this funding request to purchase wireless data air
cards for laptops. Sergeants, Deputies and Community Service Aide on patrol will qreatly
benefit from the wireless data air cards because it will allow them to communicate across
various mediums, not only BSO's Communication Center, but with local, state and national
law enforcement databases.
