R-2008- /6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE AMENDMENT OF THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF TAMARAC AND BROWARD COUNTY TO PROVIDE FOR FUNDING FOR CITYWIDE SINGLE -UNIT AND MULTI -UNIT HOUSING REHABILITATION IN THE AMOUNT OF $723,804.00 AS PART OF THE 2005 COMMUNITY REDEVELOPMENT BLOCK GRANT DISASTER RECOVERY INITIATIVE FROM THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS IN ORDER TO PROVIDE FOR THE ALLOCATION OF FUNDS INTO THE CITY'S RELOCATION ASSISTANCE PROGRAM; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, as a result of the impacts from Hurricane Wilma, the State of Florida Department of Community Affairs ("DCA") has coordinated funding to assist in the repair and rehabilitation of housing units within the City of Tamarac; and WHEREAS, the City of Tamarac submitted a plan for a project with the County that would provide for the funding for rehabilitation of units within the City in conformance with the City's previously adopted local housing assistance plan, and in compliance with applicable rules and regulations of the United States, the rules and regulations of the Department of Housing and Urban Development, the State of Florida, the 2005 Disaster Recovery Sub -Grant Agreement between Broward County and DCA; and WHEREAS, on June 27, 2007, the City Commission forthe City of Tamarac, Florida passed and adopted Resolution No. 2007-87 which authorized the execution of an Interlocal Agreement between the City of Tamarac and Broward County to provide for funding for citywide single -unit and multi -unit housing rehabilitation in the amount of $723,804.00 as part of the 2005 Community Development Block Grant Disaster Recovery Temporary Resolution #11338 January 16, 2008 Revision 1 2/27/08 Page 2 Initiative from the Florida Department of Community Affairs; and WHEREAS, the City Commission has determined that due to a need for funding to assist residents with relocation, that a certain amount of the funds provided pursuant to the Interlocal Agreement with the County shall be allocated into the City's Relocation Assistance Program; and WHEREAS, the City Commission finds that it is in the best interest of the health, safety, and welfare of the citizens and residents of the City of Tamarac to amend the Interlocal Agreement with Broward County in order to provide for the allocation of the funds to the City's Relocation Assistance Program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac, Florida hereby authorizes the amendment of the Interlocal Agreement between Broward County and the City of Tamarac for Service Area 33- citywide single -unit and multi -unit housing rehabilitation in the amount of $723,804.00, providing for funding and administration of 2005 Community Development Block Grant Disaster Recovery Initiative, previously approved by the City Commission on June 27, 2007 pursuant to Resolution No. 2007-87 in order to provide for the allocation of funds to the City's Relocation Assistance Program. The City Commission authorizes the Mayor or Vice -Mayor to sign the Amendment to the Interlocal Agreement, and for the City Manager and City staff to take any and all action necessary to effectuate the intent of this Resolution. 1 Temporary Resolution #11338 January 16, 2008 Revision 1 2/27/08 Page 3 SECTION 3. The City Clerk is directed to provide a signed copy of the Interlocal Agreement to the appropriate Broward County representative. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
