R-2008-& A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PURCHASE OF NEW COMPUTER EQUIPMENT TO REPLACE OBSOLETE SERVERS, PERSONAL COMPUTERS AND PERIPHERALS; APPROVING THE DISPOSITION OF THE REPLACED COMPUTER EQUIPMENT; UTILIZING GSA SCHEDULE 70, U.S. COMMUNITIES CONTRACT # 250-001-07-ACS, AND STATE OF FLORIDA CONTRACT #250-040-08-1; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $95,000; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 211 of the a -Gov Act of 2002, Cooperative Purchasing provides authorized State and local government entities access to information technology items offered through GSA's Schedule 70, which is on file with the City Clerk, and the Corporate contracts for associated special item numbers; and WHEREAS, on May 6, 2008, the Department of Management Services of the State of Florida authorized the use of U.S. Communities Contract # 250-001-07-ACS with an effective date from July 20, 2007, to June 30, 2009, in Memorandum No: (250-001-07- ACS)-4, on file with the City Clerk; and WHEREAS, the State of Florida awarded Contract # 250-040-08-1, which is on file with the City Clerk, to multiple vendors including Dell and HP; and WHEREAS, the proposed systems and services are available under GSA Schedule 70, U.S. Communities Contract # 250-001-07-ACS and State of Florida Contract # 250- 040-08-1; and Temp Reso# 11514 November 12, 2008 Page 2 WHEREAS, the City Commission approved the funding for replacement of obsolete servers, personal computers and peripherals in the FY2009 budget; and WHEREAS, GSA Schedule 70, U.S. Communities Contract # 250-001-07-ACS and State of Florida Contract # 250-040-08-1 include reputable vendors giving us the opportunity to pick the most suitable systems for the need; and WHEREAS, the City of Tamarac is currently a member in good standing of the U.S. Communities national purchasing consortium; and WHEREAS, City Code §6-155 allows the waiver of formal contract procedures for all supplies, materials and equipment, that are the subject of contracts with the State, the United States Government, or with other governmental agencies; and WHEREAS, it is the recommendation of the Director of IT that the servers, personal computers and peripherals budgeted in FY2009 replacement program be purchased under GSA Schedule 70, U.S. Communities Contract # 250-001-07-ACS and State of Florida Contract # 250-040-08-1 for an amount not to exceed $95,000; and WHEREAS, as a result of this replacement program, certain computer equipment has been determined to be surplus or obsolete; and WHEREAS, the computer equipment may yet be useful for the applications of other entities or individuals; and WHEREAS, pursuant to §6-153 of the Code of Ordinances, the City Commission may by Resolution direct the City Manager to dispose of the surplus supplies by the method or methods deemed to be most advantageous, convenient and economical to the City; and WHEREAS, the City Manager may dispose of surplus stock by utilizing competitive 1 1 Temp Reso# 11514 November 12, 2008 Page 3 sealed bids, public auction, established markets, sales at posted prices, donation, or trade- in as may be prescribed for the individual situation; and WHEREAS, the City Manager has delegated the responsibility for property disposal to the Director of Information Technology and the Purchasing and Contracts Manager; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to purchase budgeted computer equipment from listed vendors under GSA Schedule 70, U.S. Communities Contract # 250-001-07-ACS and State of Florida Contract # 250-040.08-1 and to approve the donation of surplus and obsolete computer equipment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City Officials are hereby authorized to purchase servers and personal computers from vendors listed in GSA Schedule 70,-UrS. Communities Contract # 250-001-07-ACS and State of Florida Contract # 250-040-08-1, during FY2009 for an amount not to exceed $95,000. SECTION 3: The appropriate City Officials declare that the surplus and obsolete computer equipment to be replaced be disposed of by the method or methods deemed to be most advantageous, convenient and economical to the City. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp Reso# 11514 November 12, 2008 Page 4 SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
