CITY OF TAMARAC, FLORIDA
RESOLUTION NO. 112008 -3(
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, OPPOSING HOUSE BILL 991, KNOWN AS THE
"VOX POPULI — VOICE OF THE PEOPLE ACT"; FINDING THAT HOUSE
BILL 991 IS UNNECESSARY AND ITS ADOPTION WILL BE AN
ENCROACHMENT ON THE MUNICIPAL HOME RULE AUTHORITY
GRANTED BY THE FLORIDA CONSTITUTION AND STATE STATUTES;
URGING THE FLORIDA LEGISLATURE TO REJECT HOUSE BILL 991;
DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE GOVERNOR, THE BROWARD LEGISLATIVE
DELEGATION AND OTHER MEMBERS OF THE FLORIDA LEGISLATURE,
AS WELL AS ALL MUNICIPALITIES LOCATED WITHIN BROWARD
COUNTY AND THE BOARD OF COUNTY COMMISSIONERS FOR
BROWARD COUNTY; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on February 19, 2008 Representatives Hukill, Nehr, Patterson, and
Weatherford filed House Bill 991 (hereinafter referred to as "HB991 "), known as the "Vox
Populi — Voice of the People Act"; and
WHEREAS, the expressed purpose of HB991 is to "delineate and prescribe
uniform requirements with respect to opportunities for citizen input and full citizen
participation at official meetings of governing bodies of local government authorities";
and
WHEREAS, the City Commission of the City of Tamarac (hereinafter referred to as
the "City") takes pride in its tradition of promoting public participation at its meetings and
considers HB991 to be an unnecessary procedural mandate regarding how local
governments should conduct business; and

WHEREAS, the City Commission believes that the involvement of the general
public is an essential aspect of local government, however the City Commission further
determines that HB991 is a threat to the home rule powers granted to municipalities by
Article VIII of the Florida Constitution and Chapter 166, Florida Statutes; and
WHEREAS, the City Commission deems it to be in the best interests of the citizens
and residents of the City to oppose HB991, creating the "Vox Populi --- Voice of the People
Act", and further urges the Florida Legislature to reject the same.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
Section 1. The
foregoing "WHEREAS" clauses are
hereby
ratified
and
confirmed as being true
and correct and are hereby made a
specific
part of
this
Resolution.
Section 2. The City Commission of the City of Tamarac, Florida hereby opposes
HB991, proposing to create the "Vox Populi — Voice of the People Act" and urges all
municipalities in Broward County to join in this opposition. The City Commission hereby
further urges the Florida Legislature to reject HB991.
Section 3. The City Clerk is hereby directed to provide a certified copy of this
Resolution to the Governor of the State of Florida, the Broward County Legislative
Delegation and other members of the Florida Legislature, and all municipalities in Broward
County, and the Board of County Commissioners for Broward County.

Section 4. All resolutions or parts of resolutions on in conflict herewith be, and
the same are hereby repealed to the extent of such conflict.
Section 5. If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 6. This Resolution shall become effective immediately upon its
passage and adoption.
