RESOLUTION NO. R-2008- ,.3-1
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO APPROVE A REFUND IN THE AMOUNT
OF TWENTY THOUSAND FIVE HUNDRED FORTY-EIGHT
DOLLARS AND NO CENTS ($20,548.00) WHICH WAS AN
OVERPAYMENT ON COMMERCIAL ALTERATION PERMITS
05-1386, 05-2321, 06-254, 06-2658, 06-3049, 06-3211, 06-
5268, 06-5999, 06-6271, 06-6558 AND 06-6591; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac received a request from Industrial Development,
Inc. to review and recalculate permit fees charged on twelve (12) interior commercial
alteration permits at Bldg B, East 6262-6270 Hiatus Road, Bldg B, West 6250-6258 Hiatus
Road, Bldg C, East 6300-6308 Hiatus Road, and Bldg C, West 6312-6320 Hiatus Road;
and
WHEREAS, the Building Operations Manager, Fire Chief and Directorof Community
Development recommend the refund of $20,548.00 for fees associated with permits 05-
1386, 05-2321, 06-254, 06-2658, 06-3049, 06-3211, 06-5268, 06-5999, 06-6271, 06-6558
and 06-6591 as identified in the spreadsheet attached hereto as Exhibit 1 and Exhibit 2;
and
WHEREAS, available funds exist in the accounts 146-0000-347-3010 Public Art
Fees and 120-0000-363-2215 for said purpose; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to refund $20,548.00 in Building Permit and associated fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the request to refund $20,548.00 in Building Permit and
associated fees, is HEREBY APPROVED.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5: This Resolution shall become effective immediately upon its passage
and adoption.
