R-2008- &p A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A TIME EXTENSION OF EIGHTEEN (18) MONTHS FOR FINAL SITE PLAN APPROVAL AND DENIAL OF A WAIVER OF THE FEE FOR THE EXTENSION FOR THE MONTEREY PROJECT, REQUESTED BY THE LAW OFFICES OF BILLING AND COCHRAN (GERALD L. KNIGHT), ON BEHALF OF THE APPLICANT (BRUCE CHAIT, OWNER PRESTIGE HOMES) (CASE NO. 7-SP-08); PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 10 of the City of Tamarac Code of Ordinances provides that the City Commission may grant time extensions on Site Plan approvals; and WHEREAS, the City Commission of the City of Tamarac, Florida, approved a Site Plan for Monterey on April 25, 2007 via Resolution No. R-2007-59 (attached hereto as Exhibit "2", Temp Reso No. 11171); and WHEREAS, the Law Offices of Billing and Cochran (Gerald L. Knight), on behalf of the applicant (Bruce Chait, Owner Prestige Homes), for Monterey has requested to have the Site Plan extended for eighteen (18) months and a waiver of the fee for the extension (attached hereto as Exhibit "1" and Exhibit "4"); and WHEREAS, the Director of Community Development recommends approval of the eighteen (18) months Site Plan Extension and denial of a waiver of the fee for the extension; and Temp Reso # 11397 — May 5, 2008 Revision #1 — May 12, 2008 Page 2 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to grant a time extension of eighteen (18) months for final Site Plan approval and a waiver of the fee for the extension for Monterey requested by the Law Offices of Billing and Cochran (Gerald L. Knight), on behalf of the applicant (Bruce Chait, Owner Prestige Homes). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the application for an eighteen (18) month extension for the Monterey final Site Plan and a waiver of the fee for the extension, requested by the Law Offices of Billing and Cochran (Gerald L. Knight), on behalf of the applicant (Bruce Chait, Owner Prestige Homes), is HEREBY APPROVED subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in the Development Review Status Sheet (attached hereto as Exhibit "3", Temp Reso No. 11171 of Resolution No. R-2007-59) and approved final engineering drawings. B. Commencement of construction shall be no later than eighteen (18) months from April 25, 2008 for the Monterey Site Plan. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Commission consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: That if, in the future, there were more stringent requirements for approval of a Site Plan, that Monterey would modify their Site Plan to accommodate those new regulations. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption. Section 213 of Resolution No. R-2007-59 provides as follows: B. Commencement of construction shall begin no later than one (1) year from the date of this approval, If the development does not commence construction within one (1) year, this approval is null and void unless an extension has been granted in accordance with applicable regulations." Section 10-2(c)(9) of the City Code of Ordinances also provides that site plan approval will expire one (1) year after the date of approval unless a building permit has been issued for the construction of all the facilities provided in the site plan and construction is dill ently pursued. The developer of the Monterey project is also developing the Sabal Palrn project, The tiro projects are being developed iu sequence, with the Sabal Pahli project being developed first and the Monterey project second. Construction activities; consisting of earthwork and infrastructure installation, have already conunenced within the Sabal Palm project; however, no conStrUctlol7 activities have conlnlenced and no building permit has been issued to date for the "constrltctlon of all facilities in the site plan" within the Monterey property. Ms. Jennifer Bramley April 22, 2008 Page 2 As you are aware, the Monterey project will consist of 232 single family and townhouse residential units. Since obtaining site plan approval, the developer has continued to pursue the numerous governmental approvals required to construct the project. For example, the City Land Use Plan Amendment designating the property for residential development was recertified by the Broward County Planning Council on August 23, 2007, and the developer received final plat approval from the Broward County Commission on October 9, 2007. Since approval of the final plat, the developer has been working diligently to satisfy the requirements to record the plat. The developer has also applied for and is close to obtaining the South Florida Water Management District Environmental Resource Permit for the development of the Monterey property. In addition to the time required for obtaining necessary governmental permits and approvals, the downturn in the real estate market in South Florida and the unprecedented lack of usually available sources of credit, have created serious obstacles to the developer's attempts to move forward with the Monterey project. Notwithstanding these obstacles, the developer has commenced construction activities on the Sabal Palm property and intends to proceed with the development of the Monterey project in a manner that can be supported by the market. The developer estimates that it will be able to commence vertical construction within twelve (12) months and continue thereafter as the absoption rate dictates. Therefore, the developer is requesting an extension of site plan approval for a period of eighteen (18) months until October 25, 2009.
