RESOLUTION NO. R-2007-�
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
APPROVING A REQUEST OF SABAL PALM
ASSOCIATES, LTD FOR A RELEASE OF
RESTRICTIVE COVENANTS IN ORDER TO
MODIFY RESTRICTIONS IMPOSED AS A
RESULT OF PLAT APPROVAL; AND
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO ACCEPT AND EXECUTE A
DECLARATION OF COVENANTS, CONDITIONS,
AND RESTRICTIONS (HERETO ATTACHED)
WITH SABAL PALM ASSOCIATES, LTD. FOR
THE SABAL PALM PROJECT, AUTHORIZING
AND DIRECTING THE APPLICANT TO RECORD
SAID DOCUMENT IN THE PUBLIC RECORDS
OF BROWARD COUNTY, FLORIDA AND
SUBMIT ALL COPIES OF SAID DOCUMENT TO
THE CITY CLERK OF THE CITY OF TAMARAC,
FLORIDA; PROVIDING FOR CONDITIONS OF
APPROVAL; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the property owner is requesting approval for a partial release of
restrictive covenants in order to modify restrictions imposed as a result of plat approval;
and
WHEREAS, the impact upon the configuration of the property as a result of this
partial release is negligible; and
WHEREAS, a Declaration of Covenants, Conditions and Restrictions (hereto
attached) will be executed that will ensure the recreation parcels remain; and
WHEREAS, the Director of Community Development recommends approval; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac, to authorize the
appropriate City Officials to accept and execute a declaration of covenants, conditions, and
restrictions (hereto attached) for the Sabal Palm project located generally west of NW 46th
Avenue, and south of NW 59th Street, to permit a recreation building (clubhouse) and
portions of the parking lot and drive aisle within private recreation parcels; authorizing and
directing the applicant to record said document in the Public Records of Broward County,
Florida and submit all copies of said document to the City Clerk of the City of Tamarac,
Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the City Commission hereby approves the request of Sabal
Palm Associates, LTD for a release of restrictive covenants in order to modify restrictions
imposed as a result of plat approval; is HEREBY APPROVED.
SECTION 3: That the appropriate City Officials are hereby authorized to
accept and execute a declaration of covenants, conditions, and restrictions (hereto
attached) for the Sabal Palm project located generally west of NW 46th Avenue, and south
of NW 59th Street.
SECTION 4: That the applicant is hereby authorized and directed to record
said document in the public records of Broward County, Florida and submit all copies of

SECTION 5: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 7: This Resolution shall become effective immediately upon its
adoption.

DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS
THIS DECLARATION OF COVENANTS, AND RESTRICTIONS
("Declaration") is made and entered into as of this ay of August, 2007 by and between Sabal
Palm Associates Ltd., a Florida limited partnership, whose principal mailing address is 315 S.
Biscayne Blvd., P Floor, Miami, Florida 33131 ("Owner") and the City of Tamarac, a municipal
corporation organized and existing under the laws of the State of Florida, whose principal address is
7525 NW 88t` Avenue, Tamarac, FL.
RECITAL
1. Owner is the fee simple title owner of certain real property ('Property") located in
the City of Tamarac, Broward County, Florida ("City"), which is legally described in Exhibit "A"
attached hereto and incorporated herein by this reference.
2. Ordinance 72-31, as amended by Ordinance 76-12 and Ordinance 76-56 of the City
("Ordinance"), requires the dedication or restriction of lands for recreational purposes as a condition
of plat approval for any residential development project.
3. The Property has been platted and the City has granted the necessary development
permits authorizing the construction of residential multi -family dwelling units and associated
accessory structures on it.
4. Owner desires to restrict the use of two parcels of land that are part of the Property
in order to comply with the Ordinance, which parcels of land are legally described in Exhibit "A" &
"B" attached hereto and incorporated herein by this reference ("Parcel R 1" and "Parcel R-2"
respectively) .
NOW, THEREFORE, in consideration for the foregoing recitals and other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Owner
declares that the Property shall be held and conveyed subject to the following restrictions, covenants
and conditions, which are for the purpose of protecting the value and desirability of the Property,
and which shall run with the Property and be binding on all. parties having any right, title or interest
in the Property or any part thereof, their heirs, successors and assigns:
Restrictions as to Parcel R-1. Owner hereby covenants, agrees and certifies, in
so far as the rights, powers, interests and authority of the Owner is concerned, that
the use of Parcel R-1 shall be restricted to recreational purposes, including, but
not limited to, lake/open space, recreational buildings or clubhouses, restrooms,
swimming pools, shuffle boards, tennis courts, other game facilities and
parking/traffic circulation.
2. Restrictions as to Parcel R-2. Owner hereby covenants, agrees and certifies, in
so far as the rights, powers, interests and authority of the Owner is concerned, that
the use of Parcel R-2 shall be restricted to recreational purposes, including, but
not limited to, restrooms, swimming pools, shuffle boards, tennis courts, other
game facilities and parking/traffic circulation.
3. Release of Previous Covenants. That certain Covenant that is recorded in
Official Record Book 6416, page 327, and that certain Covenant that is recorded
in Official Record Book 6995, Page 631, both of the public records of Broward
County, Florida, are hereby released and shall be of no further force and effect as
to the Property.
4. Enforcement. This Declaration may be enforced by the City or any owners or
renters of any residential unit located on the Property at law or in equity against
any party or person violating, or attempting to violate, any of the covenants and
restrictions contained herein.
5. Term. The restrictions, covenants and conditions of this Declaration shall run with
and bind the land for a term of ninety-nine (99) years from December 4, 1975 (date
first Covenant was recorded).
6. Modification or Release. Parcel R-1 and R-2 may be modified or released from
this Declaration. Should this Declaration be so released, amended or modified,
the City shall forthwith execute a written instrument effectuating and
acknowledging such modification, amendment or release. All amendments hereto
shall be recorded in the Public Records of Broward County, Florida, and shall not be
valid until recorded.
7. Para rraaph Headings. Paragraph headings, where used herein, are inserted for
convenience only and are not intended to be a part of this Declaration or in any way
define, limit or describe the scope and intent of the particular paragraph to which
they refer.
8, Effective Date. This Declaration will become effective upon its recordation in the
Public Records of Broward County, Florida.
9. Governing Law. This Declaration and the enforcement of the rights and obligations
established hereby shall be subject to and governed by the laws of the State of
Florida.

10. Recordation. Owner shall, at its sole cost and expense, record this Declaration in
the Public Records of Broward County, Florida. Owner shall provide the City with
proof of the recording of the Declaration in accordance with the provisions of this
paragraph.
