R-2007--6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PURCHASE OF DATA CENTER EQUIPMENT TO HOUSE THE CITY'S NETWORK, TELECOMMUNICATIONS AND DATA PROCESSING SYSTEMS IN THE NEW FACILITIES -IT BUILDING FROM DELL—APC, UTILIZING STATE OF FLORIDA CONTRACT #250-000-03-1; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $91,647.43, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State of Florida awarded Contract #250-000-03-1, which is on file with the City Clerk, to multiple vendors including Dell computer and CDW-G; and WHEREAS, on July 18, 2006 the Department of Management Services of the State of Florida issued an Extension Provision for Contract# 250-000-03-1 with a renewed effective date from August 1, 2006 to December 31, 2007 in Memorandum No: (205-000- 03-1)-10, on file with the City Clerk; and WHEREAS, a new facility to house the Utilities and IT Departments is currently under construction in the Public Services Complex; and WHEREAS, the new facility includes a data center to house the City's central network, telecommunications and data processing systems; and WHEREAS, a turnkey solution proposed by Dell-APC attached hereto as Exhibit 1 includes all engineering, installation, startup services as well as the necessary hardware and software; and. Temp Reso#11127 February 6, 2007 Page 2 WHEREAS, although it is not anticipated that the system can be installed prior to December 2007, Data center design documents need to be prepared and incorporated into the overall building construction plans to obtain all appropriate permits; and WHEREAS, the proposed systems and services are available under State of Florida Contract #250-000-03-1; and WHEREAS, quotations were solicited from State of Florida contractors as required under the terms and conditions of the State of Florida Contract, copies of such quotes are on file with the City's Clerk; and WHEREAS, Dell-APC provided the most comprehensive solution at the most competitive cost; and WHEREAS, funding for this equipment is available in the Utilities Complex project account; and WHEREAS, City Code§6-155 allows the waiver of formal contract procedures for all supplies, materials and equipment, that are the subject of contracts with the State; and WHEREAS, IT IS THE RECOMMENDATION OF THE Director of IT that the new Data Center equipment installation services be purchased from Dell-APC under State Contract #250-000-03-1 for an amount not to exceed$91,647.43; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to purchase the Data Center solution proposed by Dell-APC under State Contract #250-000-03-1. 1 1 1 1 Temp Reso#11127 February 6, 2007 Page 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The appropriate City Officials are hereby authorized to purchase a Data Center equipment and installation services from Dell-APC under the State Contract #250-000-03-1 for an amount not to exceed $91,647.43. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
