A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, FINDING PROPERTIES RECEIVED BY THE CITY
AS A RESULT OF COUNTY QUIT -CLAIM DEEDS PURSUANT TO
SECTION 197.592(3), FLORIDA STATUTES, TO BE OF NOMINAL VALUE;
FINDING THAT THE RISK OF LIABILITY AS A RESULT OF OWNING
CERTAIN PROPERTIES FAR OUTWEIGHS THE NOMINAL VALUE OF
SAME; AUTHORIZING THE CITY ATTORNEY'S OFFICE TO PREPARE
QUIT CLAIM DEEDS AND CONVEY FEE SIMPLE INTEREST OF SUBJECT
PROPERTIES TO THE PREVIOUS OWNERS; AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO TAKE ALL STEPS NECESSARY TO
EFFECTUATE THE INTENT OF THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Broward County, a political subdivision of the State of Florida, pursuant to
Section 197.592(3), Florida Statutes, will convey, or has conveyed via quit -claim deeds, certain
properties ("Properties") as more fully described in the Exhibit "A", which is attached hereto
and incorporated herein by reference, to the City of Tamarac ("City"); and,
WHEREAS, Broward County originally acquired the Properties because the owners
failed to pay real estate taxes on the Properties; and,
WHEREAS, the City, upon notice that the Properties will be deeded by the County to
the City, reviewed the locations of the Properties, and found that the Properties encompass
portions of open space, buffer areas, vehicle and pedestrian ingress/egress, parking, swimming
pool and other common areas; and
WHEREAS, the City staff and legal counsel has determined that the properties have a
nominal value, and there was significant liability risk associated with the City owning the
Properties, that the Properties were significantly encumbered, and determined the Properties
values were not substantial to justify the City selling the Properties for any sum; and
WHEREAS, the City Commission hereby finds that the risk of liability of owning the
Properties far outweighs the nominal value of the Properties, and that it is in the best interest of
the health, safety, and welfare of the City to convey the Properties to the previous owners.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:
Section 1: The foregoing WHEREAS clauses are hereby ratified and confirmed as
being true and correct, and are hereby made a specific part of this Resolution upon adoption
hereof.
Section 2: That the City Commission of the City of Tamarac finds it to be in the best
interests of the citizens and residents of the City of Tamarac to quit claim the Properties included
in Exhibit "A", which is attached hereto and incorporated herein by reference, back to the
previous owners. as the Properties have minimal to no value, and also to avoid the significant
risk of liability associated with owning the Properties.
Section 3: The City Commission of the City of Tamarac, does hereby authorize the
appropriate City officials to execute the necessary documents, including any quit -claim deeds, and
to take all steps necessary as may reasonably be required to effectuate the intent of this resolution.
Section 4: This Resolution shall take effect immediately upon adoption.
