RESOLUTION NO. R-2007- /?�
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A
COOPERATIVE AGREEMENT BETWEEN THE CITY OF
TAMARAC AND THE AMERICAN RED CROSS
PROVIDING FOR THE USE OF THE TAMARAC
COMMUNITY CENTER AS A POST EVENT SHELTER IN
THE EVENT OF A LOCAL DISASTER; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac recognizes that
victims of local disasters may need emergency shelter and care immediately
following the disaster; and
WHEREAS, the American Red Cross is chartered by the United States
Congress and charged with providing assistance to individuals and families in
need as a result of a disaster; and
WHEREAS, the Broward County Chapter of the American Red Cross has
attempted to identify facilities able to serve as shelters for local disasters; and
WHEREAS, the Tamarac Community Center has been identified as an
appropriate facility within the City of Tamarac for use in the aftermath of a
disaster; and
WHEREAS, the City Commission recognizes the benefits of providing a
local shelter for Tamarac residents who may be temporarily unable to occupy
their homes due to damage from storms, flood, fire or other disasters; and

WHEREAS, the Broward Chapter of the American Red Cross will provide
assistance including personnel, supplies, and training necessary to operate the
local shelter, and will reimburse the City for certain expenses; and
WHEREAS, the American Red Cross and the City of Tamarac have
agreed to the terms and conditions of the Agreement, as evidenced by their
Statement of Understanding, attached hereto as Exhibit A; and
WHEREAS, it is the recommendation of the Fire Chief and the Director of
Parks and Recreation that Tamarac cooperate with the American Red Cross to
provide a post event shelter for Tamarac residents in the event of a local
disaster; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
cooperate with the American Red Cross to provide a post event shelter for
Tamarac residents in the event of a local disaster.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution.
SECTION 2: The City Manager or his designee is hereby authorized to
execute the Statement of Agreement between the City of Tamarac and the
American Red Cross, Broward County Chapter.

SECTION 3: All Resolutions or parts of Resolutions in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.

Statement of Understanding
between
The City of Tamarac
and
The American Red Cross
Broward County Chapter, FL
I. Purpose
The purpose of this Statement of Understanding is to outline the working relationship
between the City of Tamarac and The American Red Cross, Broward County Chapter,
FL, hereafter referred to as the "Red Cross" in preparing for local disaster relief
situations. This statement provides a broad framework for cooperation between the two
organizations in rendering assistance and service to victims of local disaster.
II. a. Definition of Disaster
A disaster can be caused by an act of God or human events, and would include
occurrences such as hurricane, tornado, storm, flood, high water, wind -driven water,
tidal wave, earthquake, drought, pestilence, famine, fire, explosion, building collapse,
transportation wreck, or other situations that would cause human suffering and create
needs that the victims could not alleviate without some form of assistance.
b. Definition of Local Disaster
A disaster affecting a small geographic area; in this case, within the municipal
boundaries of the City of Tamarac, Florida.
III. Authority — The American Red Cross
By congressional charter dated January 5, 1905, The American National Red Cross
was designated the nationwide agency through which American volunteers extend
assistance to individuals and families in need, as a result of disaster. In part, the
charter charges the American Red Cross ---
To continue and carry on a system of national and international relief
in time of peace and apply the same mitigation the suffering caused
by pestilence, famine, fire, floods and other great national calamities,
and to devise and carry on measures for preventing the same.
The Broward County Chapter of the American Red Cross has been chartered by The
American National Red Cross to provide services in Broward County, FL. The Broward
County Chapter of the American Red Cross is responsible for developing a special
disaster preparedness and relief organization comprised of the best -qualified volunteers
available. The Chapter Disaster Committee studies the disaster hazards of the territory
and surveys local resources for personnel, equipment, supplies, transportation,
emergency communication, and facilities available for disaster relief.

The Broward County Chapter of the American Red Cross is located at 6710 W. Sunrise
Blvd. Suite 111, Plantation, FL 33313.
IV. Authority — City of Tamarac
"The City of Tamarac ...shall hereby....have all governmental, corporate and proprietary
powers and duties granted or imposed by or not expressly prohibited by law to enable it
to conduct a responsive and efficient municipal government, perform municipal
functions and render municipal services." (Tamarac Charter Article 1)
Historically, the involvement of local municipalities in disaster situations is widely
recognized. As a result of the City's desire to assist in response and recovery for
people affected by natural disaster(s) or severe damage caused by human events,
Tamarac may make its designated facilities available to the Red Cross as mutually
agreed upon.
V. Methods of Cooperation
Cooperation and coordination between the Broward County Chapter of the American
Red Cross and the City of Tamarac in time of disaster and during the post -disaster
recovery period are to be maintained at a level that ensures maximum efficiency and
good stewardship.
Both organizations agree as follows:
0 A system of communication between the two organizations will be
maintained through conferences, meetings, telephone,
electronic/computerized venues and facsimile transmissions, on an
"as needed" basis.
0 The names of the local representatives for the City of Tamarac will be
periodically proposed to the Red Cross. The Red Cross will work in
partnership with the assigned City of Tamarac representative(s).
0 The City of Tamarac has agreed to provide the use of their facility
(Tamarac Community Center), when mutually agreed upon with the
Red Cross, in support of local disaster relief operations.
0 The Red Cross agrees that it shall request implementation of this
agreement through its authorized representative.
0 The City of Tamarac agrees that it will make every effort to provide
the facilities, at no cost, when requested by an authorized
representative of the Red Cross, on behalf of victims of a local
disaster.
0 The City of Tamarac and the American Red Cross will negotiate
funding for use of utilities prior to occupancy or use of such facilities.
0 The Red Cross agrees to provide prompt reimbursement for
expenses related to portable equipment, including electric
generators, if necessary.

0 The Red Cross will conduct a site inspection prior to use of the facility
and reimburse the City of Tamarac for any products/services that are
utilized or any damages that occur due to negligence by the Red
Cross in conducting its relief activities.
0 The Red Cross will provide Disaster Training in Mass Care and
Shelter Management to the City of Tamarac staff members.
This Statement of Understanding provides the basis on which the Red Cross and the
City of Tamarac will cooperate, both in preparedness planning and in aiding
survivors in time of local disaster. Termination of this Statement of Understanding
by either party may be effected by the delivery of written notice to authorized
personnel of either agency, to be effective thirty (30) days after mailing of such
notice. Nothing contained herein shall be interpreted to waive the sovereign
immunity protection afforded the City, its agents, servants and employees, as
provided for under section 768.28 F.S. as amended from time to time.
