RESOLUTION NO. R-2007- /ff
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO RENEW THE AGREEMENT WITH PRESTIGE
PROPERTY MANAGEMENT AND MAINTENANCE, INC. FOR
GROUNDS MAINTENANCE AND LANDSCAPING SERVICES
FOR CERTAIN PUBLIC RIGHTS -OF -WAY AND CITY PARKS;
EXTENDING THE AGREEMENT UNTIL DECEMBER 8, 2010;
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTE CHANGE ORDER THREE (3) TO THE AGREEMENT
FOR PROVISION OF SAID SERVICES ON CERTAIN ACQUIRED
AND/OR IMPROVED PUBLIC PROPERTY; AUTHORIZING
BUDGET AMENDMENTS FOR PROPER ACCOUNTING
PURPOSES; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on December 8, 2004, the City Commission of the City of
Tamarac, Florida approved Resolution R-2004-265 authorizing an Agreement
with Prestige Property Management and Maintenance, Inc. for the provision of
grounds maintenance and landscaping services for certain public rights -of -way
per Bid Number 04-30B, incorporated herein by reference and on file in the office
of the City Clerk; and
WHEREAS, on January 26, 2005, the City Commission approved
Resolution R-2005-08 authorizing Change Order 1 to the Agreement with
Prestige Property Management and Maintenance, Inc. for the provision of
grounds maintenance and landscaping services for certain parks and parks
parcels, incorporated herein by reference and on file in the office of the City
Clerk; and

WHEREAS, the Agreement with Prestige Property Management and
Maintenance, Inc. is commenced on December 8, 2004 and is effective until
December 8, 2007; and
WHEREAS, per Resolution R-2004-265, the Agreement may renewed for
one (1) three (3) year period; and
WHEREAS, the Public Works Department has deemed the services
provided by Prestige Property Management and Maintenance, Inc. to be of
acceptable quality and that the pricing is competitive and acceptable; and
WHEREAS, subsequent to the approval of R-2004-265 and R2005-08, the
City has acquired and/or improved public rights -of -way and parks that should be
included in this agreement; and
WHEREAS, on an interim basis Change Order 2 was approved for an
amount of $20,000 for additional services incurred in Fiscal Year 2007 for
additional services; and
WHEREAS, Change Order 3 in an amount not to exceed $68,324.63 is
required to cover additional services attributed to existing and foreseeable
additional and improved public rights -of -way; and
WHEREAS, funding for change order 3 is available within the FY 2007
Approved Budget; and
WHEREAS, the Public Works Director, Parks and Recreation Director,
and the Purchasing and Contracts Manager recommend renewal of the
Agreement with Prestige Property Management and Maintenance, Inc. and

authorization of Change Order 3 to said Agreement, hereto attached as Exhibit 1
and Exhibit 2, respectively; and
WHEREAS, The City Commission of the City of Tamarac, Florida deems it
to be in the best interest of the Citizens and residents of the City of Tamarac to
approve renewal of the Agreement with Prestige Property Management and
Maintenance, Inc. and authorize Change Order 3 in an amount not to exceed
$68,324.63 for said purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS' clauses are HEREBY ratified
and confirmed as being true and correct and are HEREBY made a specific part
of this Resolution upon adoption hereof.
SECTION 2: The appropriate City Officials are HEREBY authorized to
renew the Agreement with Prestige Property Management and Maintenance, Inc.
extending the agreement until December 8, 2010, hereto attached as Exhibit 1.
SECTION 3: The appropriate City Officials are HEREBY authorized to
approve Change Order 3 to the Agreement with Prestige Property Management
and Maintenance, Inc., in an amount not to exceed $68,324.63, hereto attached
as Exhibit 2.
SECTION 4: All budget amendments for proper accounting purposes are
hereby authorized.
SECTION 5: All Resolutions or parts of Resolutions in conflict herewith
are hereby repealed to the extent of such conflict.

SECTION 6: If any provision of this Resolution or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other
provisions or applications of this Resolution that can be given effect without the
invalid provision or application, and to this end the provisions of this Resolution
are declared to be severable.
SECTION 7: This Resolution shall become effective immediately upon its
passage and adoption.

The City wishes to exercise the three (3) year renewal option for our Agreement to provide
City -Wide Landscape Maintenance Services for the City of Tamarac which was dated
December 8, 2004, and effective for the original term from December 8, 2004 through
December 7, 2007. Upon agreement of your firm, the renewal period will be effective
December 8, 2007 through December 7, 2010.
Please execute two (2) originals of the attached Amendment and have your company's
Corporate Secretary attest to the signature on each original. In addition, please ensure that
the Corporate Acknowledgement is fully notarized. We ask that you return the two (2)
original documents to the Purchasing & Contracts Division no later than November 19,
2007. In addition, the City will require that we have the most recently updated Certificate
of Insurance as soon as possible.

AGREEMENT AMENDMENT #1
BETWEEN THE CITY OF TAMARAC
AND
PRESTIGE PROPERTY MANAGEMENT AND MAINTENANCE, INC.
The City of Tamarac, a municipal corporation, with principal offices located at
7525 NW 88th Avenue, Tamarac FL 33321 (CITY), and Prestige Property Management
and Maintenance, Inc., a Florida corporation with principal offices located at 3300 SW
46th Avenue, Davie, FL 33314 (hereinafter referred to as "Contractor') agree to amend
the original Agreement dated December 8, 2004 to provide for City-wide Landscape
Maintenance Services.
1. Pursuant to the terms of Section 2, Term, Paragraph 2.4 Renewal Term of
the original Agreement dated December 8, 2004, between the City and Prestige
Property Management and Maintenance, Inc., and in recognition of satisfactory
performance under the current term of the Agreement, the CITY hereby exercises its
rights to renew the Agreement pursuant to the three (3) year renewal option for the term
December 8, 2007 through December 7, 2010, and Contractor agrees to such renewal.
2. Amend Section 5, Compensation, Schedules and Frequencies as
originally amended by Change Order 1 date September 18, 2007, to read as follows:
The Contract Sum for the above work shall not exceed a total of Eight
Eight Thousand None Hundred Fifty NiRe [Dollars and Zere GeRtS ($7-88,959.00) Nine
Hundred Seventeen Thousand Eight Hundred Nineteen Dollars and Sixty -Three Cents
($917,819.63). Additional locations will be added as facilities open, and pricing will be
based on mutually agreeable negotiations between City and Contractor, based on
Contractor's Schedule of Bid Prices contained in Attachment A. Contractor shall be
paid for all services, including labor and materials in accordance with the Schedule of
Bid Prices contained in Attachment "A" herein title "2004 2007 Grounds Maintenance
Contract Sheet — Prestige Property Management."
3. Amend Attachment "A" of the original Agreement, to provide for additional
scope to the original Agreement.
