CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2007- 9Q
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, SUPPORTING
THE 2006 AMENDMENT TO SECTION 212.12, F.S.,
THAT ALLOWS SALES AND USE TAX DEALERS
TO FOREGO THE COLLECTION ALLOWANCE
THEY ARE ENTITLED TO AND TRANSFER THAT
MONEY TO THE EDUCATIONAL ENHANCEMENT
TRUST FUND, AND URGING ELIGIBLE BROWARD
COUNTY SALES AND TAX USE DEALERS TO
PARTICIPATE IN THIS INITIATIVE FOR THE
BENEFIT OF BROWARD COUNTY SCHOOLS;
DIRECTING THE CITY CLERK TO PROVIDE A
COPY TO THE BROWARD COUNTY SCHOOL
BOARD, TAMARAC CHAMBER OF COMMERCE,
AND OTHER INTERESTED PARTIES; PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the citizens and residents of the City of Tamarac (hereinafter
referred to as the "City") and Broward County deserve to have the best available
schools with an optimum educational environment; and
WHEREAS, the future of the City, Broward County, and South Florida is
dependent upon the quality of the educational environment afforded to students;
and
WHEREAS, Florida schools were recently ranked by Education Weekly
Magazine as 31 out of 50 states in how well young people are being prepared to
achieve success academically and in their careers; and

WHEREAS, the Educational Enhancement Trust Fund serves as an
important source of monies for various academic improvement initiatives
throughout the state of Florida; and
WHEREAS, the City supports creative Legislative initiatives to enhance
the learning opportunities and educational environment afforded to Florida's
students; and
WHEREAS, in 2006 the Florida Legislature passed an amendment to
Florida Statute section 212.12, that provides for sales and use tax dealers
entitled to a collection allowance to elect to forego the collection allowance and
direct that said amount be transferred into the Educational Enhancement Trust
Fund; and
WHEREAS, the funds collected will be used to purchase up-to-date
classroom technology and provide teacher training in use of that technology; and
WHEREAS, between June 30, 2005 and July 1, 2006, $61 million in
collected allowances were retained throughout the state of Florida; and
WHEREAS, it is anticipated that $4 to $6 million will come to Broward
County Schools; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it
to be in the best interest of the citizens and residents of the City of Tamarac to
urge all eligible sales and use tax dealers entitled to a collection allowance to
forego the collection allowance and direct that said amount to be transferred into
the Educational Enhancement Trust Fund.

NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMRAC, FLORIDA;
SECTION 1: The foregoing Whereas clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
resolution upon adoption hereof.
SECTION 2: The City Commission of the City of Tamarac hereby supports
the Educational Enhancement Trust Fund and creative Legislative initiatives to
enhance the learning opportunities and educational environment afforded to
Florida's students.
SECTION 3: The City Commission of the City of Tamarac hereby urges all
eligible sales and tax use dealers to participate in this initiative for the benefit of
Florida's schools.
SECTION 4: The City Clerk is hereby directed to provide a copy of this
Resolution to the Broward County School Board, the Tamarac Chamber of
Commerce, and other interested parties.
SECTION 5: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 6: If any clause, section, or other part of application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining
portions or applications of this Resolution.

SECTION 7: This Resolution shall become effective immediately upon its
passage and adoption.
