R-2007--jj(o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, GRANTING A VACATION OF EASEMENT TO VACATE AN ABANDONED UTILITY EASEMENT LYING IN THE "REGINA SUBDIVISION PLAT" (PLAT BOOK 141, PAGE 23), LOCATED ON THE EAST SIDE OF UNIVERSITY DRIVE BETWEEN NW 64T" STREET AND MCNAB ROAD, SPECIFICALLY PARCELS "A" & "B" OF THE "REGINA SUBDIVISION", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 141, PAGE 23 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA;(CASE NO.4-P- 06) PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Easement described in Exhibit " 1" was dedicated to the public on November 21, 1989 at the time of the recordation of the Plat; and WHEREAS, the property owner Mural Development LLC, has determined that the vacation of the abandoned utility easement lying in the "Regina Subdivision Plat" (Plat Book 141, Page 23), located on the east side of University Drive between NW 64t' Street and McNab Road (as depicted in Attachment "A") is no longer necessary due to a previous site configuration which was subsequently abandoned; and WHEREAS, the City Engineer and franchised Utility Companies have been contacted and all have stated no objection to the vacation of the abandoned utility easement to facilitate any future improvements; and WHEREAS, the Director of Community Development recommends approval; and Temp Reso #11150 — February 28, 2007 Page 2 WHEREAS, the Planning Board recommended approval on February 21, 2007; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant a Vacation of Easement of a portion of the existing abandoned utility easement located on the east side of University Drive between NW 641h Street and McNab Road, according to the Plat thereof as recorded in Plat Book 141, Page 23 of the Public Records of Broward County, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That the Vacation of Easement of a portion of the existing abandoned utility easement located on the east side of University Drive between N.W 64" Street and McNab Road, according to the Plat thereof as recorded in Plat Book 141, Page 23 of the Public Records of Broward County, Florida; is HEREBY GRANTED. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 SECTION 5: adoption.
