R2007-9_ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ELECTING A VICE MAYOR TO SERVE A TERM OF ONE YEAR AND EIGHT MONTHS BEGINNING MARCH 28, 2007 AND ENDING NOVEMBER 2008, WITH NO SUCCESSION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in November 2006 the electorate of the City of Tamarac approved a referendum question moving the City of Tamarac municipal elections from March to November in even numbered years; and WHEREAS, subsequent to the November 2006 referendum election, Section 4.03 of the Tamarac City Charter provides: "...In March 2007 no earlier than the third Tuesday, a majority of the commissioners shall elect a vice -mayor, who shall serve until November 2008. Beginning November 2008, and each November thereafter, no earlier than the third Tuesday, a majority of the commissioners shall elect a vice -mayor. .."; and WHEREAS, Section 4.03 of the Tamarac City Charter further provides that 61. . . The vice -mayor shall serve a term of one year and shall not serve successive one year terms."; and WHEREAS, the City Clerk and City Manager recommend the City Commission elect a Vice -Mayor; and Temp. Reso. #11132 Page 2 of 3 February 5, 2007 Revision #1 03/26/007 WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interests of the citizens and residents of the City of Tamarac to elect a vice -mayor to serve from March 2007 through November 2008 and thereafter yearly, with no successive one year terms. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: That Commissioner Marc L. Sultanof is elected to serve as Vice Mayor, for a term beginning March 28, 2007 and ending November 2008, with no succession. SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 1 1 Temp.
