R-2007- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ACKNOWLEDGING A GOOD -FAITH OVERSIGHT ON THE PART OF CERTAIN MEMBERS OF THE CITY'S ADMINISTRATIVE STAFF THAT RESULTED IN SEVERAL APPLICANTS RECEIVING MORE THAN THE MAXIMUM ALLOWABLE ALLOCATION OF STATE HOUSING INITIATIVE PARTNERSHIP (SHIP) PROGRAM FUNDING; ENSURING THAT THE CITY STAFF HAS TAKEN THE NECESSARY ADMINISTRATIVE ACTION TO AVOID A RECURRENCE OF THIS ERROR; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac, Florida (hereinafter referred to as the "City"), receives approximately four hundred fifty thousand dollars ($450,000) annually in funding from the State Housing Initiative Partnership ("SHIP") program; and WHEREAS, the City's administrative staff evaluates applicants in order to determine who is eligible to receive SHIP housing assistance; and WHEREAS, due to a good faith administrative error, between the years 2003 and 2007, up to seven (7) SHIP applicants received more than the maximum allowable allocation of funding provided by the SHIP program pursuant to the City's Local Housing Assistance Plan; and WHEREAS, the City Commission acknowledges that a good faith error was made by certain members of the City's administrative staff in distributing SHIP funding and assures the State of Florida that certain policies are being crafted to ensure that such instances do not occur in the future; and SSG/JGH: 2-12-07 U:\Legislation\Drt11 L c;gislation Received\2007\07-Apr. Reso. 11154 Page 2 of 3 February 28, 2007 WHEREAS, the City Commission deems it to be in the best interests of the citizens and residents of the City to acknowledge this SHIP program funding error, and inform the State of Florida that measures are being taken to avoid a recurrence of this situation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section.1.. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2. The City Commission of the City of Tamarac, Florida hereby acknowledges that as a result of a good faith oversight on the part of certain members of the City's administrative staff up to seven (7) SHIP applicants received more than the maximum allowable allocation of funding provided by the SHIP program pursuant to the City's Local Housing Assistance Plan. The City Commission further assures the State of Florida that certain policy initiatives are being crafted to avoid any future recurrence of this error. Section 3. The City Clerk is hereby directed to provide a certified copy of this Resolution along with the City's SHIP program annual reports. Section 4. All resolutions or parts of resolutions in conflict herewith be, and the same are hereby repealed to the extent of such conflict. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
