CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R- 2007-�
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA AUTHORIZING
THE APPROPRIATE CITY OFFICIALS TO SEEK
FEDERAL SURFACE TRANSPORTATION
PROGRAM FUNDS VIA AN APPLICATION
THROUGH THE BROWARD COUNTY
METROPOLITAN PLANNING ORGANIZATION TO
THE FLORIDA DEPARTMENT OF
TRANSPORTATION IN THE AMOUNT OF $500,000
FOR AN INTEGRATED BIKEWAY/WALKWAY
SYSTEM WITHIN THE CITY OF TAMARAC;
PROVIDING FOR A 50 PERCENT CASH MATCH OF
$500,000 IN LOCAL FUNDS FOR A TOTAL PROJECT
COST OF $1,000,000 IN THE EVENT OF APPROVAL
OF THE APPLICATION; PROVIDING FOR
ACCEPTANCE OF THE AWARD AND EXECUTING
OF DOCUMENTS UPON APPROVAL; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Tamarac wishes to enhance
multi -modal transportation, wellness and recreational opportunities throughout
Tamarac; and
WHEREAS, the City desires to provide safe connectivity between City facilities,
schools, shopping areas, residential areas and the Broward County Greenway system
by establishing an integrated bikeway/walkway system throughout the City; and
WHEREAS, Federal Surface Transportation Program (STP) funds are available
for selected transportation enhancement activities; and

WHEREAS, STP funds are administered to local governments through the State
via an application through the Broward County Metropolitan Planning Organization
(MPO) to the Florida Department of Transportation for transportation enhancement
projects; and
WHEREAS, in the event of approval of the application, the City will provide the
2007 Transportation Enhancement Program fund request of $500,000 with a 50
percent cash match in local funds in the amount of $500,000 for a total project cost of
$1,000,000; and
WHEREAS, the Assistant City Manager and the Director of Parks and Recreation
recommend submission of the application and acceptance of the award in the event of
approval; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the
best interest of the citizens and residents of the City of Tamarac to apply for STP
funds via an application through the MPO to the Florida Department of Transportation
and accept the award and execute the required agreement upon approval of said
application.
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are HEREBY ratified and
confirmed as being true and correct and are HEREBY made a specific part of this
resolution.

Section 2: The appropriate City Officials are HEREBY authorized to apply for STP
funds via an application through the MPO to the Florida Department of Transportation
for project costs in the amount of $500,000 for an integrated bikeway/walkway system
throughout the City, providing for a 50 percent cash match in local funds of $500,000,
for a total project cost of $1,000,000 in the event of approval of the application. A copy
of said application is attached hereto as "Exhibit A".
Section 3: Upon approval of the application, the appropriate City officials are HEREBY
authorized to accept the award and execute the necessary documents following legal
review and approval.
Section 4: Upon approval of the grant award, the appropriate City Officials are
HEREBY authorized to amend the existing Grants Fund Budget in the amount of
$500,000 and appropriate said funds including any and all subsequent budgetary
transfers to be in accordance with proper accounting standards.
Section 5: All resolutions in conflict herewith are HEREBY repealed to the extent of
such conflict.
Section 6: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or in
application, it shall not affect the validity of the remaining portion or applications of this
Resolution.

Section 7: This Resolution shall become effective immediately upon its adoption.

2. Project Description:
Use additional sheets as necessary to respond to the following:
(a) Describe how the proposed project is related to the intermodal transportation system by either
function, proximity or impact. (One or more may apply).
(b) Where is the project located (and what are the termini, if appropriate)? Include a detailed scope
of services and location map. (aerial preferred or plan view)
(c) Summarize any special characteristics of project. Provide typical section drawings for
appropriate projects. Include right of way lines on the typical section drawings.
(d) Describe the project's existing right of way ownerships. This description shall identify when the
right of way was acquired and how ownership is documented (i.e. plats, deeds, prescriptions,
certified surveys).
(e) Describe any proposed right of way acquisition, including expected matching fund source,
limitations on fund use or availability, and who will acquire and retain ownership of proposed right
of way. *
(f) Describe any related project work phases that are already complete or currently underway.
(g) Other specific project information that should be considered.
3. Project Implementation Information:

(a) Describe the proposed method of performing (i.e_ contract or in-house) and administering (i.e.
local or state) each work phase of the project. If it is proposed that the project be administered
by a governmental entity other than the Department of Transportation, the agency must be
certified to administer Federal Aid projects in accordance with the department's Local Agency

'Reminder: District IV FDOT Enhancement Funds will only be used to fund Construction and
Construction Engineering and Inspection Activities. The total amount of Enhancement funds requested
per project must now be in excess of $200,000.

CERTIFICATION OF PROJECT SPONSOR
I hereby certify that the proposed project herein described is supported by
(municipal, county, state or federal agency, or tribal council) and that said entity will: (1) provide any required
funding match; (2) enter into a maintenance agreement with the Florida Department of Transportation; (3)
*comply with the Federal Uniform Relocation Assistance and Acquisition Policies Act for any Right of Way
actions required for the project, (4) **comply with NEPA process prior to construction, this may involve
coordination with the State Historic and Preservation Office (SHPO) prior to construction. (Not at time of
application) and (5) support other actions necessary to fully implement the proposed project. I further certify
that the estimated costs included herein are reasonable and understand that significant increases in these
costs could cause the project to be removed from the Florida Department of Transportation work program.
