R-2007-�1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, SUPPORTING FLORIDA HOUSE BILL 367, THAT WILL REPEAL THE CAP ON SADOWSKI ACT REVENUES THAT DIRECTLY FUND STATE AND LOCAL HOUSING TRUST FUNDS; AND URGING FLORIDA LEGISLATIVE REPRESENTATIVES TO SUPPORT THIS BILL AND VOTE IN FAVOR; REQUESTING THAT GOVERNOR CRIST ADVISE THE HOUSE AND SENATE LEADERSHIP THAT HE SUPPORTS HB 367; DIRECTING THE CITY CLERK TO PROVIDE A CERTIFIED COPY OF THIS RESOLUTION TO FLORIDA GOVERNOR CRIST, SPEAKER OF THE FLORIDA HOUSE OF REPRESENTATIVES, PRESIDENT OF THE FLORIDA SENATE, THE BROWARD COUNTY LEGISLATIVE DELEGATION, AND ALL OTHER INTERESTED PARTIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on January 19, 2007, Florida House of Representative Ron Saunders introduced HB 367; and WHEREAS, the bill would repeal the cap on Sadowski Act revenues for funding of state and local housing trust funds; and WHEREAS, in 2004 the Florida Legislature capped Sadowski Act revenues at $243 million with a 10% annual growth of collections increase; and WHEREAS, the cap on Sadowski Act revenues ignores population changes, natural disasters and demographic shifts; and WHEREAS, revenues from the Sadowski Act were set aside so that local governments could help low-income people become homeowners; and Temp. Reso. #11179 — April 16, 2007 Page 2 WHEREAS, the cap will become effective on July 1, 2007, thus requires immediate attention; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac and the State of Florida for programs and services to be appropriately funded so that more working and middle-class families can become homeowners. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMRAC, FLORIDA; SECTION 1: The foregoing Whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution upon adoption hereof. SECTION 2: The City Commission of the City of Tamarac hereby supports the HB 367 and urges Florida Governor Crist, the Broward Legislative Delegation, the mayor of each municipality in Broward County, the Broward League of Cities, the Florida League of Cities, and each member of the Broward County Commissioners to support HB 367. SECTION 3: The City Commission of the City of Tamarac hereby requests Governor Crist to advise the leadership of the Florida House and Senate that he supports HB 367. SECTION 4: The City Clerk is hereby directed to provide a certified copy of this Resolution to Florida Governor Crist, Speaker of the Florida House Of 1 Temp. Reso. #11179 — April 16, 2007 Page 3 Representatives, President of the Florida Senate, The Broward County Legislative Delegation, and all other interested parties. SECTION 5: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, or other part of application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 7: This Resolution shall become effective immediately upon its passage and adoption. PASSED, ADOPTED AND APPROVED this 154�day of Apy-11 , 2007.
